I can recommend a Small Claims Court action - it worked for me.
How long did you wait before going to Small Claims Court?

About 2 months after sending the CDs (and 3 unanswered emails)

If you don't mind me asking, what was the cost of filing a Small Courts Claim? I'm planning to do the same :)

IIRC it's £30, but you might be lucky to get that money back as well.

Prove of how slow TIC is, I sent off 2 parcels each containing 10 CDs on Monday, 1 to TIC (stuff Magpie didn't want) and 1 to Magpie. Lets say I've received an email from Magpie saying my cheque is in the post already.

Hmmm...I didn't choose that option. My cheque from TurnIntoCash arrived 5 days after I submitted the claim - the same day as the Court paperwork arrived!

Like yourself, they've decided to settle out of court (by sending me the cheque) and paid the full amount (including the court fees)

I would therefore suggest that everyone that hasn't received the money that they're rightly due, go through the small claims process:

    https://www.moneyclaim.gov.uk/web/mcol/welcome

You may want to include the fact that they've breached their own terms and conditions with regards to timings (in bold):
    Timings

Please note we aim to despatch customer payment within seven days of receipt but occasionally due to high volumes may not be able to do so but we will keep you informed via the website.

The following timings are for guidance only:

    • Royal Mail Freepost can take up to 10 working days to arrive

    • Courier collections generally take three working days to arrive

    • We will acknowledge receipt of your parcels individually (If you send more than one parcel we acknowledge each one)

    • From Receipt acknowledgement to us posting your cheque will usually be 14 working days but cannot guarantee this during busy periods

I've just registered with that website and I'll complete the claim over the weekend. Just read an MSE article on the website stating that Rob Fox has said traders will be paid in "weeks rather than months" !!!!

Yet they've decided not to mention that on their own website, contrary to their own terms (in my previous post).

Yeah I think Small Claims is the only way to go.
  • I also used turnintocash.com and sent my parcel by post on the 11.02.2012 and at the same time also sent a parcel to musicmagpie. I've already cashed the cheque from musicmagpie but turnintocash.com all it says is awaiting receipt. I've sent emails to there email address but i've not had any response so am left wandering what to do? Will NOT be using them again, I wish I had not heard of them. Be Warned about using turnintocash will be sticking with musicmagpie.:mad::mad::mad:

You shouldn't let them get away with it, so use Money Claims Online - https://www.moneyclaim.gov.uk/web/mcol/welcome AND also report to them Action fraud - http://www.actionfraud.org.uk/

You have to pay the court fees (£25+) but that will be added to your claim against them. They haven't got a leg to stand on, so will most likely pay out.
