i am not goingto now disappear into the wilderness but would like to share any info i can and also offer any support i can to those people who are going through what i was.

    Hi Boss,

Couldn't agree more but the old saying "there's no motion without friction" has a lot of merit.

  • Hi everyone

Didnt get back about my OR interview as have been 'dying' with real flu. Seriously awful stuff. Anyway, have dragged myself back to work now. Got heartily sick of daytime tv!! Never thought I would say that in my lifetime.

The phone interview last Thurs started ok. The chap on the other end seemed reasonable. Trouble is I was coming down with flu and think I didnt seem to be making a lot of sense. Kept getting confused and he wanted information I didnt have to hand about when payments made on visa card etc, which was over 1 year ago. Interview went on for a whole hour.

He knew about my OH's bky in December and also had a copy of his statement of affairs with him. Some of the loans he had taken out had helped me by paying towards my visa card bill as well as his, but I couldnt remember the timeline for it, so was getting confused. Even with OH beside me he couldnt think of the dates etc either.

I may have been being over-sensitive but he was giving me the impression that he didnt think I should have filed for bky as debt amounted to just less than 15k, which is about what I earn.

I explained that when I had spoken to CCCS around the time that my OH had, they thought that I would have to go bky too. And since that talk, have been given an ultimatum by tax credits (pay up £1200 before Xmas or we take you to court in Jan; plus 2 other years overpayments taking it to over £3000) and a contract mobile phone bill (in my name but for now 18-year old son, who was paying me monthly but has since lost his job, and discovered that chat rooms charge £1.50 per msg sent AND received, and are NOT included in the unlimited text msg contract, running up almost £1600 from Dec-Jan) which have pushed me even further into debt.

Since last week, the OR has been in touch twice more asking to clarify some things again. I have now sent him all documents, phone bill etc and a brief explanation which I hope will help him with his report. He was also interested in the jobs I held over the last few years, and wanted payslips for these too.

I am not sure if this is a good thing or not. He didnt seem to like the idea that I was using my son's car for work, the one we had to buy back in December/Jan for his birthday, but he hasnt passed his test yet and I need to get to work 5 days a week. So am paying for petrol and overheads for this. Works out about the same as train fares to work daily - £10 per week - but not having to wait for a train is priceless in winter as have been there before.

Cannot decide if OR was being picky or really thorough or what. Do not feel remotely relaxed about it all yet even tho it is over with. OH had a 'better' interview ie shorter and less detailed if I remember correctly and didnt have to send much of anything after his. Though I did remember him being asked a few times if he realised he was getting into debt!! I know that he owed more and earns less than me so maybe his was more straightforward.

So having thought it was going to be ok, am not feeling reassured about any of it. But as OH has said, they cannot take your bankruptcy off you! I am going to have to pay something towards the creditors for the next 3 years, probably about £120 per month, which was about equivalent to the minimum payment on visa card.

OR seemed to thing we will have money to spare, but I dont see it yet. Having had a £248 car bill in November (sadly brakes needed urgent work, and then the OR made husband give it up) which stopped me from making a full payment to visa that month, then £475 for OH's bky, then £300 to buy back the car, then £475 for my bky. We have been living off dust and scrapings for the last 3 months just to ensure monthly outgoings were met. Wasnt helped by new bank account with Co-op not sending me a mandate to take on all the direct debits from old account. All set up now as contacted them all individually but late charges Ntl - all others not in arrears, council tax last payment made on last payday instead of start of month. Rent, gas, electric, all done. Water not due at the moment.

One thing I hadnt realised is that I had owned a credit card for 20 years or more. It is really odd not having one now, though I will of course get used to it. But when cash was a problem because bills needed paying etc, it was always there to fall back on.

Ah well, better get back to doing some work then. Just wanted to update you all. Thanks for listening.

  • Hiya Everyone!!
I've not been around lately, sorry! Been busy with assignments for my course. I finally got my IPA through today and I thought I'd post about it cos this might help someone else, you never know!
The OR decided that I now have £329 per month spare. I wish!!! She set my IPA at £118 per month. Now, I know that I should be grateful for swapping £118 per month for the almost £600 I was paying on debts before. But, I phoned the OR because I couldn't see where she got my huge surpluss from. It turns out that she had 'misunderstood' some of my figures and has now come back with a much nicer figure of £55 per month! So if anyone out there gets a shock with their IPA, don't despair - it might just be worth challenging it!

    Hi
I'm a complete newbie though have been receiving main emails for ages, so thought I'd explore and register with the forum and just saw you guys. Please can I come and play!

Me and hubby went bankrupt Nov 06 (831- 2006 Plymouth) and so far .... its ok! The scariest bit was the fear of going to court but court day was straight out of Monty Python, "Bankruptcy? - one cross only, line up on the left" Since then little glitches and stupid big mouth moments but we're existing and surviving

  • Thanks for welcome! let's just hope we're all out of it soon!

One surprise I did have was when trying to get cheaper quote on car insurance renewal - trying to be sensible - contacted NFU who insure OH vehicle and after going through details asked the fatal question "have you ever been or are you BR?" result was wouldn't give quote and we had to pay years insurance for OH vehicle in full as their direct debit company doesn't deal with bankrupts. Very harsh when you're trying to take control.

Are there any other traps to watch out for like this? Have several other DD arrangements that I would like to check if could be done cheaper but tempted just to sit and wait. On the other hand now we're dealing with this and not ostriching anymore it feels wrong
