    just when i thought everything was getting sorted i only went and crashed my car yesterday.might be a write off but dont know till wednesday.husbands got or interview on monday hope that doesnt go as bad.

    This is my first post. Not been able to register before - some technical thingy as was using Firefox and have now been shown how to do it properly by hubby using Explorer.

    So here I am. This is my first day after going BR yesterday. Not really sunk in yet but getting there I guess. Can I joint the club too please?

    My OH went BR in December and it has been a bumpy ride, both leading up to his and then mine. Glad to be this side of it now though.

    ME - lol I have been too busy with Millie's jabs, and ultrasound scans, OR interview etc all in one week, to post. Baby doing well for 9 weeks, so all is good in our neck of the woods.

    Sorry to hear that. You may be able to add a new(used) car cost into your expenditure so all may not be lost. Hope you have a better day today.

  • Thanks TJ. Have found reading all the posts on this thread so helpful to both of us before MWT's bky in December and mine this week. Sorry to hear about Tammyfshr damaging car. Sometimes you get a really dreadful run of bad luck.

    Just a little update in case anyone else is looking for a bit of advice for a similar situation to us.

    Back in December MWT asked if anyone knew what the OR did about cars as he 'owned' 3 - a 10-yr old Vectra (worth about £600) and 2 Morris Marinas (one £450 other £300), she actually took quite a tough line on us. I was running the Vectra and paying all expenses, MWT paid for other 2, but all registered in his name. One Marina was meant for our son for his 18th.

    She said he could only keep ONE car, even though all together came to less value than £1500. He kept the tax-exempt older car; we had to find another £300 to buy back the one for our son (his birthday being 8 days after MWT went bankrupt) and 'my' car disappeared off to be sold.

    A bit annoyed since then because apparently you could possibly argue that he may be the registered keeper but isnt the owner so maybe could have kept it after all. I had paid towards all the purchases of cars and felt hard done by. But on the plus side, when I have my interview with OR I do not own a car myself so do not have any assets.

    I am currently using son's car - he hasnt passed his test yet, but the receipt is in his name. Still, better than public transport, and cheaper than it too.

    Also we had a problem with the tax credit people as we had been overpaid for 3 consecutive years 04-05, 05-06 and this current year - the first one when I went from being single parent to joint claim and they kept paying me until joint claim came through. I honestly had had no problems with TC until then and didnt know that it was meant to stop - naively thought it would be taken into account when new claim started being paid. It isnt!

    Anyhow, had contested their claim that I was overpaid, and received a letter 12 months ago saying I had lost the appeal and had to pay, only never heard any more from them, so kinda hoped they had dropped it.

    When we received a letter this year for the following tax year (05-06) saying we had been overpaid again but on our joint claim, MWT included that in his bky as one of his creditors. We notified TC of his bky on the day he did it in December. I then became the sole 'owner' of this debt and it triggered off a letters telling me to pay the original overpayment of £1200 by Christmas. Yeah right! What with? Not nice to get them though.

    I contacted them back to say we were waiting to hear from OR for husband to see if he had to pay anything towards his creditors or not. They were not sympathetic at all, and were on the point of starting court procedings - even though I told them I had nothing to pay them with. Certainly not after the original costs of £475 plus the £300 for the car. Man, if we had any money left after that we wouldnt have been in this boat in the first place.

    When they look at what you can pay them back monthly, she made it quite plain that they do not take into account any credit card repayments or loans, so if you were scraping money together to pay off the minimum or whatever, they do not include that as a 'legitimate' expense.

    The silly woman told me we had an excess of £400 per month by her calculations - which I contested - and that I must pay £80 per month minimum (whilst waiting for the OR interview for him) for 48 months though this must go up after his interview is settled.

    She had been most unhelpful and kept behaving like a money lender, putting pressure on me to agree to a sum of repayment that I couldnt afford or she would set court procedings going. My first payment is due on Monday and have sent her a copy of the declaration from court about my bky, telling her the OR will be in touch soon.

    The best thing she did for us though was put all the debts for overpayment into my name. This really helped as I could put them down as one of my creditors and MWT wouldnt be held accountable for the overpayment for this year. I had been worried we wouldnt find out until after April 07 as they usually dont tell you about an overpayment until after then, but they actually sent us a letter early, probably as we had the other overpayments.

    I had been advised by MyVesta that it could not be included as a creditor if they had not notified me before going bankrupt, though CCCS had thought it could be included but had nothing to back this up with. MWT asked the OR in his phone interview and she wouldnt allow it against his bky if it hadnt been included in the list of creditors and sums owing. I then worried that if I included it as one of my creditors he would still be accountable for the joint overpayment etc etc.

    One other thing, I had signed up to a mobile phone for my son on contract about 18 months ago. He was working pt time and still at school. He left school in Feb last year and worked full time since then and so had upgraded in Aug last year. Sadly he ran up a huge bill on his phone (blooming chat lines - although text msgs were unlimited on his contract, chat lines are classified as data pages apparently, which he didnt know until bill arrived !!!) at same time as losing his job in November (rocky year all round) . I was advised by both CCCs and MyVesta that I could include the remainder of the contract (another 12 months x £45 pcm) as one of the creditors and include the huge bill, so have done.

    Anyway, am totally skint now for the next few weeks until payday. Glad the freezer is full - have been buying 'bargain' food for weeks now knowing this was possibly coming though had hoped we could get back on even keel after OH's bky first. Christmas was painful and son's 18th birthday didnt exist sadly. Still for a joint total of about £40k being written off in bky between us I guess it is worth it in the long run.

    Anyway, am off to go and sit in front of fire in other room - one of our cost cutting exercises was to open up the coal/log fire to save gas. May not see a benefit moneywise just yet, but it is great to sit and relax in front of it!
