Changing a childs name -Help needed.

  • i married when my son was 5 and he said he wanted to keep his own name. it's been 5 years now and this week i've applied for his new passport, still in the surname he was born with.

    some people think it's strange that i 'allowed' him to keep his surname at age 5 but i think i did the right thing, he really didn't want to change his name. my husband isn't offended, he understands my son. mum didn't change our surnames after dad left us, and it's my dad's surname that my son has.

    i think a child should be able to decide for themselves which name they want, if they are old enough to have an opinion.

  • spud knows he could change his to my husband's at any time, so if he ever gets tired of explaining why he has a different surname to his parents (and his little brother now too) he has the option.

    I changed my son's name when he was 11 by Statutory Declaration (Deed Poll). This was with his father's permission (he had PR). I didn't have to go to Court, a document was drawn up by my solicitor (which I never ever received an invoice for) and which I signed and this was witnessed.

    I'm unsure whether you can prepare your own document and have it witnessed (like you would with a Will). If you'd like me to PM you the wording, I'd be happy to.

    Blimey, I didn't realise this post would cause so much animosity! For the record, the kids don't like using their fathers name. When their birth surnames are used, this upsets my children.

    Since I posted this, their father has returned from overseas... I didn't know this till I was at a club the other week and saw him and his wife... I simply reminded his wife (saw her in the toilet) that it was her husbands daughter birthday the following week - she was shocked and they left the club soon after... Needless to say my daughters birthday came and went without so much as a card... so you will forgive me if I don't give a crap about your ideas of wrong and right.. it's right for US.

    Thanks for all the helpful advice though people... though now he's back it looks like I'm back to square one... Spending our lives trying to avoid him so as not to upset my children any further when he blanks them in the street :( xxx

    You can also apply for a passport for them in their birth name and you just need to send in your decree absolute and your birth certificate as well as normal documents. I had to apply for one for my daughter last year and as I had divorced her father years ago and since remarried I also had to send my new birth certificate. I might be easier that way than trying to show proof of a "known by" name for children.
  • I changed mine for £8 it was a statatory declaration, the CAB gave me a form with spaces in for me to fill in my new and old names and i paid £8 and stood in front of some magistrates and swore on the bible it was stamped and hey presto....it was good enough for the passport people.

    I was told I could change my childrens names in this way too.
