    Aye very unfair, not.

Of course it's unfair, if there are no road markings to corroborate the speed, and it's a traditional Gatso, which isn't approved for forward-facing use.

Sounds like it's a Truvelo, though.

OP, try pepipoo for some advice.

GATSO flash and take pictures of the rear as you pass.

TRUVELO do not flash and take pictures of the front as you approach.
TRUVELO do flash but there is an opaque magenta filter over the flash so as not to distract the driver - it's easier to see it at night :).

People who have asked for the photograph in order to "help identify the driver" receive one with a megenta tint to it.

There is no chance of contesting the fine so it looks like 3 points and £60 for not being able to see a bright yellow reflective box.

Not so quick - even if it was a Truvelo, we don't even know when the alleged offence took place, and when the OP received his NIP.
  • If a gatso flashed you head on (which they can do but shouldnt in UK) wouldnt it show you as actually going slower than 0mph considering you would be driving towards it?

No, they are designed to operate in forward or rear facing mode. In the UK they are not approved for forward facing use.

I would say in the OPs case it was a Truvelo.

OK after further research, it would appear that this is a PEEK camera, not any of the above. (speedcameralocations.co.uk)

The camera is situated inbetween 2 roads either side. There are road markings on both roads to indicate that the camera should be facing the rear of the traffic on either side of the road. The camera would normally be directed at the road markings on one the sides of the road but this time it was facing on-coming traffic, giving me the impression that it was defunct and the police didn't bother with it any more.

Anybody know anything about these cameras and my legal rights?
  • are you sure there wasn't one on each side of the road and you got caught by the other?

Although your defence is a bit lame 'i thought it was defunct so i carried on speeding'

OP, have you actually received a NIP yet?

Have you actually received paperwork and if so what exactly ?

Your "legal rights" if prosecuted, are to reject any offer of a Speed Awareness Course or Fixed Penalty and choose to plead Not Guilty and have your case heard in court, although as you admit the offence, this may be a risky strategy .... whilst the points awarded by the court will be the same as an FPN, the fine will be based on your income level and could be a lot more than the standard £60.
