I wonder if anyone can help me clarify some dates please?
I issued MCOL against HSBC & have confirmation that it was served on the 28th March. My Q is this, they have acknowledged that they wish to defend (pretty standard) & have 28 days now, but with Easter, I am having trouble figuring out what date by they have to respond???
I'm thinking 29th March - 28th April (= 31 days, less the 3 Easter days), so they have to midnight on the 28th April - Am I right ....
Does the 28 days include weekends?
Thanks in anticipation of replys
Hi Helmbroken,
It is worked out in calendar days, so Wednesday 25th April should be fine.

Hi there, I am claiming approx. £670 off Nationwide. So far they have denied responsibility and so I have taken it to court using money claim online. They acknowledged the claim which game them 28 days to reply. On the Thursday before the Easter Bank Holiday I rang the court and asked when I could apply for Judgement. The woman advised on the Tuesday after the hols but she then said I can actually do it Monday night at midnight. So i stayed up and it let me file for judgement, where as previously I couldnt because not enough time had passed. Anyway the next day I checked online and it had been rejected! I asked them why and they said I had filed for judgement too early and I would have to send a manual form in. I did that but now Nationwide are defending the claim in full and denying the charges, and I await to hear what will happen next. What should I do? Surely theres no defence they can make to justify their charges?? Please help if you have gone through the same kind of thing.0

PoC = Particulars of Claim. Some Courts are now chucking out the cases pursuant to CPR Rule 16.1 (basically no substantive case) unless more substantive particulars are given.0

Hi All
I have been lurking here for months, and didn't like to bother you but i'm at the stage now where I need advice.
I have 2x claims with MCOL, both Issued on 04/04/07:
Nationwide - £320
Lloyds TSB - £992
For each claim I sent 3x copies of my Schedule of Charges to the court in Northampton for thier information.
Nationwide acknowledged on 11/04/07 (according to online MCOL).
What i'm confused about is when is their time up for entering a defence? Is it 14 days from 11/04, or 14 days from date of issue 04/04? (Sorry, know this has been stated previously but can't work it out).
As for Lloyds. No acknowledgment as yet, just status as "issued". Since filing claim though, I have incurred a further £95 charges.
My question is, how and can I add these charges on to the total???
Do I send amended Schedule of Charges to Northampton Court, ask to amend claim in whole, or leave it and be happy with my original claim amount?
I would be very very grateful if someone could help me with my queries. I think your all doing a fab job.... :A0 -
help. I got letters through off MCOL saying the court case was issued on 10th but will be classed as recieved on the 15th. When does the 14 days period start from the 10th or the 15th please help.0

In your letter from the Courts it states the date when the defendant has to, mine is the 1st May 07. I started the process on 12th, the claim was issued that day and the Court gives the delivery of your claim of 5 days so the papers should arrive my the 17th in my case.
In your case the 14 days starts from the 15th, so your bank needs to reply by the 29th April 07."I AM THE GATEKEEPER OF MY OWN DESTINY" Nacho Libre

Hi there,
I started a claim against simply Be back on April 1st. It was issued on the 3rd April. Does this mean they have 19 days from the 3rd or the 1st of april to file a defence?
Also i started two claims for different accounts with HSBC. It was issued on the 5th April and both have just been acknowledged on April 12th. What happens next please?
Many thanks for all the help this site has given me, i think it encourages people to do whats right and fight the banks. I cant wait to post my first success post and i will definitely be leaving a nice donation so this site can continue to be successful. Go Martin:money:0
