You can put either of your names in the individual box, it does not need both names unless you to both have to sign cheques etc together.0 -
Hi ya. Sorry everyone, but my question got ignored in amongst the others! If a defendent has "until the 16th of april" to acknowledge does this mean I can claim at 1 min past midnight on the 16th or 17th?

There are some posts on here about timing, I would assume it's the 17th. However, from what I have read when some have entered judgment at 1 min past midnight etc...it lets you, then a day or so later it can change as the banks have acknowledged & the courts allow it to carry on this way.0 -

On a lighter note,my son reclaimed his bank charges,had no problems at all,and they paid up straight away!!This was with RSB --SUCCESS!!!!!!!!!

Hiya, sorry no advice as yet as Natwest have acknowledged my claim & I'm expecting the letter your daughter received anyday now. From what I've read in this thread it's a common scare letter they issue, so don't let them be put off by it. I know some people have sent the info back to them & others have not, I'll be checking back here then so I know what to do too!

When doing the MCOL do i put the interest from when i first contacted Hsbc or do you do it from the date you are doing the MCOL.0

When doing the MCOL do i put the interest from when i first contacted Hsbc or do you do it from the date you are doing the MCOL.
The interest is from the date the charge was incurred. Martins calculator helps with totting up the charges or you can x your charges only by 0.00022 to give you daily rate of interest...you will need this info for the particulars of claim with MCOL. hth x0 -
ok so we got a letter from natwest offering us our £2200 but thats without the court cost and interest. we have decided to accept the offer and i need to stop the mcol.
have been on and it gives me 2 options. i assume i choose option 2 judgement by admission then on the next page it says
I accept the defendant's proposal for payment
so clicked this but on about page 5 it says
Amount of claim as admitted
(including interest at date of issue)
£ 2619.28
but this is not what they offered us so what do i do. i cannot change this amount.
do i have to cancel the court proceedings instead of completing the mcol form??0 -

If you've decided to settle out of court, you do not have a judgement.
Wait until you actually get the money and then let the court know the claim has been settled to your satisfaction.0
