    Hi there,

I started a claim against simply Be back on April 1st. It was issued on the 3rd April. Does this mean they have 19 days from the 3rd or the 1st of april to file a defence?

Also i started two claims for different accounts with HSBC. It was issued on the 5th April and both have just been acknowledged on April 12th. What happens next please?

Many thanks for all the help this site has given me, i think it encourages people to do whats right and fight the banks. I cant wait to post my first success post and i will definitely be leaving a nice donation so this site can continue to be successful. Go Martin:money:

    Hi!

They banks have 19 days from the date of issue to acknowledge and if the acknowledge they have 33 days from the date of issue :)

  • Hi Pigsmightfly,

I was just wondering if you had any ideas on my earlier post (first one). You seem to be a very helpful person!
I'm in a bit of a pickle regarding adding more charges onto my already filed MCOL claim.

    Hi!

I'm not really sure ont his one to be honest. I know you can add charges to your claim if by the time you go to start your claim, more charges have been added but once the claim has been started I am unsure.

I would email MCOL (their details are on the claim site) and ask them to advise.

I have emailed them a few times with questions and they are really helpful.

Good luck and let me know how you get on :)
  • Oh brilliant, thank you for your response. I will email them this afternoon. If I can't amend the claim without a lot of hassle, I think i'm going to put it down to being a bad girl again (final time I hope). It was a genuine oversight this last time, not that that makes a difference, a charge is a charge is a charge!!

    Again, many thanks.

Hi ya. Sorry everyone, but my question got ignored in amongst the others! If a defendent has "until the 16th of april" to acknowledge does this mean I can claim at 1 min past midnight on the 16th or 17th?
    Ta!
I've just started entering the competitions (July 07). When I win I'll update this signature. Look on the bright side, I shouldn't have to update it very often.

Q At what point do you ask for a change - once /after you have started with money online or say at the outset on the form that I prefer Preston eg I know many staff at Black pool and would prefer Preston re Confidentiality

Wait until you receive the notice of a court date and they will tell you in what court the action will be heard. Then write and request a change to your preferred court and state reasons for change - proximity etc. If you are concerned that your will get a based position from a court or confidentiality you can also ask for one not quite so close on these grounds. That does not always work but does most times.
    Good luck

    Hi guys
I was advised that the additional charges could not be claimed on this as they could be considered to take the claim beyond the six years. I have had extra charges since and advised my bank I intend to claim on these in addition to the existing claim. My plan is then to raise it in court if we get to that stage. If not I will use the threat and waive their settlement at them to try and force a refund. And if that fails I will start again. Whatever happens i am determined to not let them get away with it
If anyone else has gone further already and has a view I also would be grateful to hear about it.
