Do watch out for the standard PoC's as courts are beginning to chuck them out in which case the court fees will be wasted. See some of the other threads.
  • Hi

Just submitted my MCOL form this afternoon. I know that my bank has 14 days to respond from when they receive the claim but I have a couple of questions...

    i) Do I just need to keep checking online to see when my claim has been served or do I need to wait for paperwork from the Court?;
ii) Do I include weekends in the 14 days or is it working days only?
iii) If they do acknowledge within 14 days do they then have a further 28 days to enter a defence?

    Any advice much appreciated.

    Many thanks :rotfl:

to reply. So, can I claim at 1 minute past midnight on the 16th, or does that day have to pass, so it would be 1 minute past midnight on the 17th?!
I've just started entering the competitions (July 07). When I win I'll update this signature. Look on the bright side, I shouldn't have to update it very often.

    Hi

I wonder if anyone can help me clarify some dates please? :D

I issued MCOL against HSBC & have confirmation that it was served on the 28th March. My Q is this, they have acknowledged that they wish to defend (pretty standard) & have 28 days now, but with Easter, I am having trouble figuring out what date by they have to respond :o ???

I'm thinking 29th March - 28th April (= 31 days, less the 3 Easter days), so they have to midnight on the 28th April - Am I right ....
Does the 28 days include weekends?

Thanks in anticipation of replys

Hi, I filled everything in this morning to ask for judgement by default and I just checked and it says my judgement's been 'rejected' and I can't go any further online, it doesn't say why.

What does it mean? Does anyone know??

Sorry for posting on multiple boards but I'm really worried

The court will send a letter stating when the papers are deemed served, it's 5 days from tomorrow. But do keep an eye online too. The days are calender days, not working days & if they do acknowledge they will have 28 days in total, so another 14 days from the 14 days stated by the court, if that makes sense?!

    Hi isa

Call MCOL and ask them , as you will only be able to deal with it when you have the facts, when I spoke to them regarding my claim they were extremly helpful and made me feel that they were on my side-so to speak
    Best of Luck

    Hi,

I issued a court claim on the 4/03/07. My bank issued an "acknowledgement of service" on 07/03/07, stating they would defend. That is the only paper work I received.

Then on 04/04/07 I received a "notice of transfer of Proceedings". So now I am playing at home. With this I received a copy of their defence.

but what happens next? There is no refence to a court date, or any other detials I need to fill in.
  • Hi

Can someone help me,I had filled out all the claim last night so the process as mentioned today. So what happens now, how long will the whole process take now until I get any charges back, if any? posts are mentioning 14 days/28 days etc. So I need some clarity?
