Hi i have checked my online claim this morning and barclays havent put in a defense so i tryed to do the judgement by default section however barclays have changed the address to the livitgations and disputes department
to level 29 1churchill place london e14 5hp but the money claim website says that postcode does not exsist so it wont let me continue has anyone else had the same thing and did you solve it, its annoying becasue i had to get this win by default in by 9am this morning but because of this i cant

Yes, If you try clicking on either of those two options it will tell you you need to wait 14 days before you can select those.0 -

Just a quick question. I have started the court procedure against Lloyds TSB with MCOL and checking online states it was issued 25/01/07, am i right in thinking it takes 5 days for it to be served/serviced to Lloyds TSB?? If so is it 5 working days?
Then does the 14 days for them to acknowledge start from then? Or has it already started from the day it was issued??
Sorry if this has been answered,i have looked but couldn't see anything

14 days from the date issued. Keep an eye on your claim online. You can track progress there. The bank will probably acknowledge your claim next giving them an extra 14 days to enter a defence. After this, you will receive a form from the court, and notice of where the case has been transfered to (your local county court).How many surrealists does it take to change a lightbulb?

Can anyone please give me a very brief idiots guide to the court stage of the reclaim process?
I have registered with moneyclaim and inserted all the details needed on to my form.
Can anyone tell me if they take Electron cards as payment?
Once the claim has been submitted, what then happens?
Do I have to send paperwork off? If so what?
Should it go recorded?
What should I expect to then happen?
How long does the process normally take?
I feel really out of my depth now but am determined that on Monday I want this finally sorted and submitted so would be grateful for a bit of support and help to get me on my way. It's been sitting around for months and I vowed that I would get it all dealt with in the new year!0 -
I think they take Electron cards but I'm not sure. Once your claim has been completed and paid for, the papers will be sent to the bank and you will receive a letter informing you when they received the papers. They have 14 days from this date to acknowledge the claim. If they don't do so you can claim judgement by default. If they do acknowledge it will show up as such on your MCOL, and they then have further time to enter a defence. That will also show up on your MCOL. They have 28 days in total from the time they are issued the papers to acknowledge and submit an intent to defend. Some banks go to the acknowledgement stage and then settle, some don't even file an intent to defend. Worse case scenario is having the court date set, in which case you will be sent an allocation questionnaire. There are guides to completing that on this site or on the Consumer Action Group's website. have their been any cases of banks acknowledging claims on theday or day before their 14 days would have been up thus giving them a further 14 days to respond and luling the claimant into a flase sense of security.
I'm asking because I issued claims with both Halifax and Capital One on the 23rd Jan. Capital One have acknowldged thus giving them an extra 14 days but Halifax have not. Its still showing up as 'issued' and their 14 days is up on Tuesday. I'm thinking they might now acknowledge on mon, the day before...Does anyone have experienece of Halifax using this tactic?0 -

I posted a claim with money claim for £1513.50 against HSBC who have acknowledged that they are defending. If I want to claim interest I had to include "The claimant claims interest under section 69 of the County Courts Act 1984 at the rate of 8% a year from {date when the money became owed to you} to {the date you are issuing the claim} of £ {put the amount} and also interest at the same rate up to the date of judgment or earlier payment at a daily rate of {enter the daily rate of interest}. " I put that I'm claiming £1513.50 from 4/8/00 (date money became owed) but I put 29/01/06 which should have been 07 as I made a mistake. in the daily rate I put 0.0219% is this right? and how can I change anything that was wrong?0
