    No, that figure is completely wrong. To work out the daily rate...........

    multiply your charges only (no interest added) X .00022

    My total charges are £540 x 0.00022 = 0.1188 is the daily rate
    Is that right? Cheers

    So I would £0.12 in the particulars of claim. I'm just confused because the other template says 'This amounts to a total sum of [insert amount of interest], continuing to accrue at the statutory daily rate of 0.021% until judgment or earlier payment. Sorry for being pedantic, I just don't want to make an error when putting my court claim in. Nice one!!

    I'm asking because I issued claims with both Halifax and Capital One on the 23rd Jan. Capital One have acknowldged thus giving them an extra 14 days but Halifax have not.     This might be a prudent warning to anyone waiting for the 14 days to be up from issuing MCOL claims. I waited for the 14 days and HBOS did not acknowledge service so at 9.30 on the 15th day (you can't request judgement until after midnight on 14th day) I requested judgement. As it was after 9am it won't be dealt with until tomorrow (day 16). Unfortunately HBOS's achknowledgement was entered by them online at 9.45 and overrides my request for judgement...

    It might be stupid but waiting til midnight or before 9am on the 15th day would certainly be the time to get that judgement requested if nothing is heard by the banks...

    I guess now i'm awaiting my allocation questionnaire... Bring it on then...

    Thanks for that. I will almost certainly be staying up then tonight till gone 12 so I can press the judgment button!

    please could someone help me on my claim form on moneyclaim it asks do i want judgement by default or judgement by addmission wot one do i put?

    My claim was issued on 22nd Jan, but the letter from MCOL says that it will be deemed to be served on the 27th Jan. The defendant has until the 10th Feb which is a saturday.

    So on saturday morning i can click on

    The defendant has not filed an admission or defence to my claim
    (Judgment by Default)

    ???

    This MCOL form is doing my head in. I'm not thick but so worried about getting it all wrong. In one of the templates for the particulars of claim it has a space for the date account opened. Does it matter if my guess is out?
    Also, what name do I put for the claimant if it a joint account and all letters so far have been written in both our names?
    Help needed. Thanks.
  • Hello All

    Thanks to the wonderful advice and templates on this site I have been taking action against Barclays to reclaim £1800. My claim was issued throught Money Claim Online and they filed an acknowledgment on 15/01.

    They had until midnight last night to file a defence. At just gone midnight there was still nothing so I requested a default judgement and went to bed. This morning I checked at about 11am and it showed my judgement had been requested and still nothing from Barclays.

    Now I'm confused...I went on the site again at 6pm today and it suddenly says 'Defence 03/01/07'. I don't understand this and it was too late to ring Money Claim by then.

    Does this mean Barclays have submitted a defence and it has been accepted? There was nothing on there by midnight last night or 11am this morning but this afternoon there was. Surely they're too late?

    Now it says I have to wait to hear which court it has been allocated to. And that my judgement request has been rejected today!

    Any advice you could give would be so much appreciated as I won't be able to sleep now!!
