If the banks defence is received even a few days after the first deadline. The courts normally let the case go on rather than grant any judgement. This is quite normal, and has happened many times.

You now have to wait to receive your allocation questionnaire from the court.

Barclays have got a big habit of taking the cases as far as they can, but not going into a hearing. There is not one case they have defended fully yet.

    Just a quick question,

got a letter saying bank have until the 7th to reply...which is today and they havent :j assuming the claim status would say "acknowledged" as it still says "issued" Can I go ahead with Judgement now or do I have to wait until the end of today?

    TIA

Jen *hovering over the judgement button*

PS anyone had a similar experience (with judgement I mean) this hasnt happened to me before?

Read the posts in this thread above yours. They deal with this situation.

Rex - interesting to hear about Barclays' defence habits. Does anyone have experience with Bank of Scotland (HBOS) going as far as a court hearing? I've had two claims (£5200 and £800) with MCOL just been acknowledged so I'm waiting for Allocation Questionnaire.

    Thanks as always...

See the Bank of Scotland thread to see how others are getting along with this bank.

If it helps.............There has been no word of one single case defended fully, and won by this bank.

  • i made yet another error...read the court information properly! I assumed that as my claim was 'issued' on the 23rd January the 14 days would be up today, but in fact you need to add another 5 days onto that date to account for them being served with the papers so in fact I cannot ask for judgement until sunday which that means a few more days of waiting nervously in case they file an acknowledgment of service between now and then.

is this a good or bad sign?

Which bank was that for? It just means that the bank has an extra 14 days.
It will be 28 days from the date the claim was 'deemed' served which is 5 days after you issued the claim, so in theory it will be 33 days after you issued your claim that you can ask for judgement, if nothing happens inbetween of course
