Try it tomorrow, but if the bank has acknowledged the claim, they will have an extra 14 days to submit a defence. Also, if the acknowledgement arrives a little bit late, the court will most likely allow the case to continue rather than award judgement.

  • Thanks as usual Rex, what would we do with without you! :)
I'll try again tomorrow then. I also submitted a claim against capital one on the same day but they acknoweldged so have an extra 14 days. My halifax claim is still showing as issued so I'm guessing it was 14 days since the day it was issued which was the 23rd Jan.
  • Can anyone tell me if I can claim back overdraft interest? Every month I pay out approx £50 in interest but have been told I can only claim back what goes over my overdraft limit.
    Thanks

You cant claim back your normal overdraft interest. Only any interest incurred by charges that take you over your overdraft limit. Working this out accurately can be a complete nightmare. You have to be accurate because your figures may be challenged by the bank, and you need to prove them correct.

  • ok thankyou for letting me know I don't think i'll bother I will just stick to my original bank charges
  • hi! i received a letter from hsbc's solicitor about 2 weeks ago.. asking me for a breakdown of the charges (which i had already done) and also to add what each charge was exactly for and seperate interest amounts for each charge (which i had not done - had just added the interest together)
anyway.. i just wondered.. on moneyclaim now.. they have entered that they are defending my claim and that i can't do anything more online now.. i just wondered what happens next? i have not heard anything more from the solicitors and i am worried about what to expect next.. i have no time limits now for them, so will they just take ages doing anything else more now?
    any help appreciated!

You will get a letter from the court next with an allocation questionnaire. See post #8 in THIS THREAD for a guide to filling this in.

8% until judgment or settlement at a daily rate of £0.xx;...
What daily rate do I put in the particulars of the claim? Cheers

    Is the daily rate 0.021%?

No, that figure is completely wrong. To work out the daily rate...........

multiply your charges only (no interest added) X .00022
