Moneyclaim Online (MCOL) question

Hi all,
Just filling in the form online and using the wording given on here, but not sure how to make clear I'm only claiming up until December last year. Should I add/alter anything, or just leave it, as it's all clear on my schedule when it's submitted.
On the subject of schedules, I have two ... the first one I typed out from bank statements, giving the reasons for charges, dates and amount, which I submitted with my letters to the bank. The second I've done recently from Martin's calculator to work out the interest. When the time comes, should I submit both schedules to the court. Hoping I don't have to amalgamate the two, as it's one hell of a list!
Any help greatly appreciated ...Wins since 2009 = £17,600MANY THANKS TO ALL OPS0 -
Can anybody please advise on my query below?
ThanksI put my claim onto MCOL last night but realised that I used the Andover address for Lloyds instead of the registered address? Is this going to be a big problem?

Hi can anyone advise please...
I'm in process of filling out claim form on mcol site but having a problem working out my interest ammount as when i origionally started the process of reclaiming my charges i went for contractual interest. There is no mention of this in the mcol form and i dont want to put wrong ammounts in. Has anyone else claimed contractual?? who can advise. Thanks0 -

Contractual Interest will be included in the total amount claimed - if you are claiming contractual interest you MUST file the claim using the N1 form as opposed to moneyclaim. You need to include the reasons for claiming it. Look at CAG for help.
Timescales of Moneyclaim
Day 1 ISSUE CLAIM
Day 3 CLAIM SERVED on DEFENDANT
Day 17 DEADLINE FOR ACKNOWLEDGEMENT OF SERVICE (if they dont do this you can request default judgement)
Day 32 DEADLINE FOR DEFENCE ENTERED IN COURT (if they dont do this you can request default judgement)
Then you will receive a copy of the defence from the court and the defendant. You will also receive your allocation questionnaire to complete and return.
Then you wait for directions from the court.
CLAIMS should be filed against the banks REGISTERED ADDRESS. Its not a huge problem if you file against a branch instead.
I'll go through now and answer more in depth queries.LegalBeagles0 -
I understand that but I was under the impression that to make a small claim the amount had to be under 5k before interest(mine is £4980) but when trying to enter the claim it says you have to add the interest which then makes it over £6K making the fee £250 and therefore causing it to be fastrack.
In Martins explanation he says it should be under £5000 before interest is added.
Martins right if you are scared off fasttrack.....there is no need to be scared of fasttrack. The interest shouldnt be taken into account for allocation of track purposes so you may still be in small claims. converseley there have been £400 claims put in fast track.LegalBeagles0 -

Dear Sir/Madam
(Your Name) –v- (Bank)
Claim No: ********
Date Issued: xx/xx/xx
Please find enclosed a schedule of penalty charges taken from me by the defendant, along with interest claimed at the annual rate of 8% pursuant to section 69 of the County Court Act. The interest in addition to the amount in charges equates to the total amount of my claim, namely £(AMOUNT).
I respectfully request that the enclosed schedule should be attached to the particulars of my claim.
Yours sincerely,LegalBeagles0 -

what is an n1 form and cag sorry for the ignorance0 -
I got an offer today from Halifax of less than half the basic amount I was claiming (not including stat interest).
I was about to log a claim on MCOL but I just noticed that there was a typo in my interest spreadsheet where one claim was logged as 2003 whereas in fact it was in 2006. This has now reduced the interest I am claiming and means that the last 2 letters I have sent them quotes the incorrect amount of interest.
Now I am not sure what to do - I dont want to end up in a weaker position if it goes to court because my documentation was incorrect.
Can anyone please advise?
Make sure your spreadsheet is right and the amounts are correct on your claim. Dont worry about the error in the letter - the court claim is the important part.LegalBeagles0 -

Hey guys! I made a claim on moneyclaim online for £1400, the bank (halifax) acknowledged, but didn't get a defence put it. I clicked the "judgement" button and applied for a judgement by default, and it now says this has been "issued" to the bank
What does this mean? How long do I need to wait for the next section now? (there is also a link for 'warrant' now available)
I've had a look for more info but can't find any, and the mcol site doesn't really tell me the next steps or when I should take them
You applied for judgement by default and you dont understand what it means ?
