    Hi all,

    Just filling in the form online and using the wording given on here, but not sure how to make clear I'm only claiming up until December last year. Should I add/alter anything, or just leave it, as it's all clear on my schedule when it's submitted.

    On the subject of schedules, I have two ... the first one I typed out from bank statements, giving the reasons for charges, dates and amount, which I submitted with my letters to the bank. The second I've done recently from Martin's calculator to work out the interest. When the time comes, should I submit both schedules to the court. Hoping I don't have to amalgamate the two, as it's one hell of a list!

    Any help greatly appreciated ...

    Hi can anyone advise please...
    I'm in process of filling out claim form on mcol site but having a problem working out my interest ammount as when i origionally started the process of reclaiming my charges i went for contractual interest. There is no mention of this in the mcol form and i dont want to put wrong ammounts in. Has anyone else claimed contractual?? who can advise. Thanks

    Generic Reply :)

    Contractual Interest will be included in the total amount claimed - if you are claiming contractual interest you MUST file the claim using the N1 form as opposed to moneyclaim. You need to include the reasons for claiming it. Look at CAG for help.


    Timescales of Moneyclaim

    Day 1 ISSUE CLAIM
    Day 3 CLAIM SERVED on DEFENDANT
    Day 17 DEADLINE FOR ACKNOWLEDGEMENT OF SERVICE (if they dont do this you can request default judgement)
    Day 32 DEADLINE FOR DEFENCE ENTERED IN COURT (if they dont do this you can request default judgement)

    Then you will receive a copy of the defence from the court and the defendant. You will also receive your allocation questionnaire to complete and return.

    Then you wait for directions from the court.


    CLAIMS should be filed against the banks REGISTERED ADDRESS. Its not a huge problem if you file against a branch instead.

    I'll go through now and answer more in depth queries.

    Martins right if you are scared off fasttrack.....there is no need to be scared of fasttrack. The interest shouldnt be taken into account for allocation of track purposes so you may still be in small claims. converseley there have been £400 claims put in fast track.

    Make sure your spreadsheet is right and the amounts are correct on your claim. Dont worry about the error in the letter - the court claim is the important part.
