  • Ok so my bank have bounced a few letters back re. my claims (2x totalling £6000ish on 3 accounts). Have totally lost patience with them as last year they offered me an overdraft of £15000 (I asked for a mere £1500) They now want my overdraft back, (they can have it when they give me my fees back) but for the pleasure of their 'clerical error' offering me an overdraft that shouldn't have been offered they now charge me £50 pcm to 'manage' my account. (NB. 'Managing" my account to the HSBC means not applying DD or SO when I request and generally passing me from pillar to post) :mad: RANT OVER anyone else feel free.........

    BUT I'm going to moneyclaim, but where's the 'what to write' text, I clink the link and get a blank page??
  • I registered my claim against Lloyds TSB on 15th March and have had a Notice of Issue at Northampton Court.

    problem 1 - The notice of issue shows the court as Northampton - I live in Gateshead and filed against Lloyds in London. Does this mean I might have to go to Northampton :confused:

    problem 2 - My PC crashed yesterday :eek:
    and the password and customer ID for the MCOL site were on it and have been lost. Is there anything I can do?

    Any help or advice would be appreciated!

    Problem 1
    Northampton is the default court - it will automatically go to your local court should a court date have to be set.

    Problem 2
    Ring up their Customer Help Desk and see what they can do. Identify yourself by the Claim number on your Notice of Issue. The Customer Help Desk can be contacted for support between 9:00am to 5:00pm, Monday to Friday on:
    Tel : 0845-601 5935

    If that doesn't help: On the MCOL site (when you click on I am an existing customer) there is a link for "Have you forgotten your password?" Just try and remember the Customer ID you chose.

    Do you have to enter this as part of the particulars of claim?
    "The claimant claims interest under section 69 of the County Courts Act 1984 at the rate of 8% a year from {date when the money became owed to you} to {the date you are issuing the claim} of £ (amount of interest only) and also interest at the same rate up to the date of judgment or earlier payment at a daily rate of {enter the daily rate of interest} To work out the daily interest. Multiply the amount of your claim (charges only, not including interest) by .00022"
    Ihave been trying to enter the edited part and when they asked you if you want to claim interest if you say yes the above come and they say you have to copy and paste into your particulars and then tells me too many characters 1127. Can you tell me if i dont put this "Claimant claims: return of the amounts debited of £XXXX; Interest per S.69 County Courts Act 1984 of 8% - £xxx [enter interest total at date of claim] continuing at 8% until judgment or settlement at a daily rate of £0.xx; Alternatively, if the charges are a fee for a service, then they must be reasonable under S.15 of the Supply of Goods and Services Act 1982. Costs allowed by the Court." but use the one at the beginning of this message??although one states the interest and the other dates Thank you for any help on this

    Done it read it properly and just put the detail required.
    Can you send copy of charges +interest to moneyclaim by email to customerservice.mcol@hmcourts-service.gsi.gov.uk
    or has to be by post.

    I am currently abroad and looking to make a claim against Barclaycard. My Dad is going to sort out all the correspondence once I have done the claim online. Is it possible for someone else to represent me? What happens if it gets to the stage where a court allocation questionnaire is sent out, would I have to physically sign that form or can someone else do it? Would I just use the Barclays Bank address when doing the claim. Many Thanks

    Also if my interest daily rate is worked out as 0.1023, I just round it down to 0.10? Also in the particulars of claim, I do not know the exact date when my account was opened, is it ok to put 'opened August 2001'? If someone could answer my questions including the previous post I will be very grateful and buy them a pint. Cheers

    Yes it would round down to 0.10.

    Sometimes I haven't known when my account was opened and I've either done what you have stated above or just left it out altogether and it never affected anything ;)
  • Hi all. As a newbie to tHIS site, I am impressed with teh content of info available. I have gone through some of this already, and I am sure somewhere will show the actual address to quote on the MONEYCLAIM online site for Lloyds TSB. I have three accounts with TSB, two dormant ones, and one live one, yet I wish to claim for all. The accounts in total do not go back more than 6 years, and I have received no response from my local branches, having requested my charges refunded. Can I add up ALL the charges, and take Lloyds TSB to court as a "collective" business, rather than issue a seperate claim against each branch? Using MOneyclaim online, would I use Gresham Street as the head office to cite in my claim online?? I hope someone can make sense of what I am asking!!!!! Thank you. ;-)
