Have never used this service before. Do you receive anything electronically when you submit an application through Moneyclaim.gov.uk ? Could someone post an example of this e-mail (with personal details removed).

    Thanks.

Hi today i pressed the start button on my mcol claim as the 28 days were up as they aknowledged on the 1st May, just looked at it and it has changed to rejected and they are saying capital one filed a defence on the 25th april which would be hard as i didnt start court claim until 26th april if any one understands what has happened please reply as i am totally confused.
  • I follwed a link from off this site to the consumer action group forum where they are advising people not to claim via MCOL quoting the follwoing message

    Warning

We do not advise that claims be filed through MCOL

MoneyClaim is no longer appropriate as the arguments in support of your claim are too long.
You can still use MCOL if you want as a placeholder but you will have to supply supplementary information once the stay's have been lifted.
Please see the N1 particulars template for better details.
We would strongly suggest that you file your claim by using the N1 form - this can be sent, or handed in personally at your local County Court. This method allows for a much more detailed particulars of claim, and a list of charges can be attached.

Has anyone recently made a claim via MCOL? I was intending to do this on Friday but no i'm not sure what to do.

If you have a choice, it is always preferable to file using N1 at your local court. The two main disadvantages with MCOL are that your Particulars of Claim are limited to just 1080 characters with a maximum of 24 lines and you cannot attach the schedule of charges to your claim.

Both these drawbacks can create problems later on. The banks use these limitations of MCOL to assert, with some justification, that the claim has not been fully particularised.

Therefore I would strongly advise you to file at your local court. Even if you file at MCOL, it will be transferred here eventually anyway.
  • Thank you for the advice. I will fill out the N1 and go through my local court. Is there any help available when filling out the N1 or is it pretty straight forward?

There are template N1 poc's on these sites:
    Other Bank Charge Websites.

There are a number of small free websites dedicated to reclaiming unfair charges and helping consumers. The ConsumerActionGroup is a focused web forum based purely around reclaiming charges; it’s run by a group of people who took on the banks in the very early stages. PenaltyCharges is run by a law student who successfully took on the banks and campaigns on the site and LegalBeagles has regular updates on the test case.
  • Thank you once again

The only email I received was acknowledging that I had registered with MCOL. But I did receive a copy of my claim through the post along with details of what would happen next.
