    • Banks have 14 days to acknowledge a claim after it's served.
In my case, this is where i am up to as i have got an acknowledgement.
    • If that’s done they have a further 14 days to respond and enter a defence. Commonly they do an acknowledgement, but no defence is entered. Again this means you win, though this time after 28 days.
Is the previous 14 day respondent period included in the 28 days, or is it 14 days wait for response, then if no defence is entered there is a further 28 day wait?
    • At that point, immediately request a ‘judgment by default’, this can be done online

Once they have asknowledged the claim they have 14 days to put in the defence
As I am not the Pope or legally qualified I may be wrong so feel free to get a second opinion from a qualified person

Hey, i'm about to do mcol for c.c charges. I am claiming back £825 in charges plus 194.12 interest (£1019.12). I have received a goodwill gesture of £429, which i accepted as part payment.

In the amount claimed bit what should i put? Should i put £1019.12 or should i put £590.12 (taking away the £429) ? Thanks in advance.

Found the answer you just claim for the amount left!!

I've paid the cheque in but waiting for it to clear, as soon as it does i'm going to submit my MCOL. I have a couple of other questions, which maybe you or anyone could answer if that's ok. I've read a lot of posts but some have confused me a bit! This is my particular's of claim bit so far.

The Claimant had an account xxxxxxxxxxxxxxxxwith the Defendant, opened xxxxxxxx. Since xxxxxxxx the Defendant debited charges and interest in respect of purported breaches of contract. Defendant is aware of all details as a list of charges has already been supplied. Claimant contends: The charges exceed the Defendant's losses caused by the breaches; The Term permitting the Defendant to levy such charges is unenforceable under the Unfair Terms in Consumer Contracts Regulations 1999, Unfair Contract Terms Act 1977 and at Common Law. Claimant claims: return of the amounts debited of £396.00; Interest per S.69 County Courts Act 1984 of 8% - £194.12 continuing at 8% until judgment or settlement at a daily rate of £0.xx; Alternatively, if the charges are a fee for a service, then they must be reasonable under S.15 of the Supply of Goods and Services Act 1982. Costs allowed by the Court.

The £194.12 is the amount of interest i calculated using martin's calculator when i wrote my first letter on 19/02/08. Do i have to work this out again so that it is up to the date i file my mcol? and also the daily rate will this be £396.00 (the amount left) x 0.00022 ? Your help is much appreciated, thankyou
