    The Claimant has an account XXXXXXXX (put your account number) with the Defendant, opened (DATE XX/XX/XXXX). Since (DATE XX/XX/XXXX) the Defendant debited charges and interest in respect of purported breaches of contract.Defendant is aware of all details as a list of charges has already been supplied. Claimant contends: The charges exceed the Defendant's losses caused by the breaches; The Term permitting the Defendant to levy such charges is unenforceable under the Unfair Terms in Consumer Contracts Regulations 1999, Unfair Contract Terms Act 1977 and at Common Law. Claimant claims: return of the amounts debited of £XXXX; Interest per S.69 County Courts Act 1984 of 8% - £xxx [enter interest total at date of claim] continuing at 8% until judgment or settlement at a daily rate of £0.xx; Alternatively, if the charges are a fee for a service, then they must be reasonable under S.15 of the Supply of Goods and Services Act 1982. Costs allowed by the Court.

    Rang them up today, apparently there was some sort of crash on their site Friday which made my claim show as "unavailable", i was assured that i would still receive some notification in the post confirming my clain is going through as normal.

    does anyone know if accidently putting 45p too much in the truth statement part will affect my claim? also the bank said i claimed 27.50 too much because it was more than 6 years ago(even tho my first letter requesting that charges back was within the 6 years). So this 27.50 is on my court claim.. will this also make me lose if i goto court and dont accept their offer? sorry for posting again, but i only have a few days left to accept their offer(and i will only accept if the above 2 things will affect my claim)

    Please help - asked this question before on a different thread but didn't get a response and really want to continue with my claim but not sure what to do next.

    I've been offered £250 towards £551 from MBNA but intend to pursue for the rest. When completing MCOL am I right in assuming that I deduct the £250 from the £551 making the claim for £301 plus interest?
    Also if this is the case, I would usually submit a copy of my original schedule of charges with the charge showing and the interest for each charge but what do I do now as they've offered £250. Do I just recalculate the interest for the new total of £301 or possibly knock off £250 worth of charges and the appropriate interest? - I'm confusing myself but hope this makes sense to someone!!

    I was wondering if anyone can enlighten me on a couple of things. I submitted my claim to mcol on 9th July, so after the 5 service days it takes me to 14th July - 14days elapsed on 28th july & have heard nothing. I have logged onto mcol & it says I have to allow them 14days, i can only presume that it does not include weekends.
    I am claiming my charges back from the RBS, but on Friday I had a letter from Wescot Credit Services telling me that my account has been placed on hold. I am claiming for £2636 inc. of interest. Can anyone shed any light on this confusing matter.

    You'll find the timings for MCOL in Beate's post in the Reclaim Help Thread which is linked in my signature but as the 28th is over the w/end MCOL allows until midnight on the Monday for the bank to put in a defence.

    It sounds like your account has been transferred to debt collection?

    i have paid my money and taken the shabbey to court over the internet on the 31st 0f july. i recieved a notice of issue today from northampton county court saying it will be issued on the 5th of august 2007 and the shabby have until the 19th to reply.

    what will happen next? i would be grateful for any advise thank you.

    It is a case of wait and see Abbey should Acknowledge by the 19 if they do not you can enter Judgment in default on 20. If they do they will have 14 days to file a defence
    As I am not the Pope or legally qualified I may be wrong so feel free to get a second opinion from a qualified person
