The retailer has emailed me and they definitely have the correct address. But they are asking for a re-delivery fee, and it sort of defeats the purpose of buying from them, which was they had a good price! And I've no guarantee that it's not just going to be sent back again with no contact!
I would be disputing this with the retailer
tell them you will not be paying for a 'redelivery' given you never had any delivery attempt
by your description the courier would have no issue getting the item delivered
So i would say resend or refund in full0 -

Thank you, that's what I thought I just wanted to check I was right to do so!

I hope you all can help me!
Order a delivery for Saturday 26th. Never arrived, called customer services twice. Once I got told, it will be with you in 20mins (already 1 hour late), then I called an hour later (2 hours late at this point). I was told the store manager would call me because there was a problem. I waited, never got a call!!!
And today I check my account and I've been charged the whole £131.71 of the shopping that never arrived.
Been on hold for nearly 2 hours today trying to get through to customer services. Ended up ringing the store, from the driver I spoke to, I get the feeling my shopping was stolen/signed for me so it looks like it has been delivered. Waiting for the store manager to call me tomorrow.
Question is, do I get the police and fraud team involved if someone has in fact signed my name? And do i ask for compensation?
Thanks!0 -
Just in case you missed it, there has been quite a lot of white stuff falling from the sky. It kind of makes it a bit difficult to move around.
but that doesn't allow them to ignore customer or lie
and that wasn't my question
can they exclude the liability in their T&C?Information - never enough, questions - always too many, decisions - not always the best

In the guide it says "time is of the essence" needs to be stated to get the protection to refuse later delivery for a full refund.
I'm wondering whether there is wiggle room for things for which a reasonable person would agree that time is of the essence. So if a person buys a bunch of flowers through a Valentine's day promotion and specifies 14th of February as a delivery date, isn't the fact that time is of the essence implied (i.e. delivering Valentine's flowers a day or two after Valentine's day is not "reasonable"). I ask because obviously the distance selling regulations wont apply here as flowers are perishable and there is no point it getting the flowers late.0 -
I had an absolute shambles with city link who are possibly the worst courier on earth, after having one sorry card i went on there website to rearrange delivery for the following day, i waited in all day but no one arrived they then came the day after and left a card saying i had to collect after two failed delivery attempts, i then hadf mothercare email them to ask them to deliver the next day before 10.30 am as i wasn't starting work til 11 the next day city link turned up with only half my delivery then we got a phonecall at 1pm asking us where our house was as they had another delivery for us i.e. the rest of my goods, in the end they attempted delivery 8 times and didn't show up when they were supposed too, even though these delivery times were arranged with them through mothercare, in the end city link sent my goods back to mothercare who them arranged a local courier to deliver one night after work, the whole thing was a shambles in the end, i did not receive an apology from city link, but i did receive a £50 compensation from mothercare to which i was happy with, any other complaints about citylink let me hear them0

Could someone please advise on whether I can reclaim time wasted by BT Openreach/Plusnet?
Basically, they charge £50 for a missed appointment for installing fibre. They missed their first appointment (and only told me at 5pm on that day that they wouldn't come), so I am considering asking them for the same fee now...0 -

HI MSE,
I used your late delivery complaint letter and Time is Essence sentence, and got a reply. Any advice what I should do next.
Thanks

Dear Sir or Madam,
Order number: xxxxx
Ref: Delivery complaint due to breach of contract
On 22 December 2012 you agreed to sell me Price Buster DoubleFaux leather Ottoman bed frame.
It was agreed you would deliver to me on Friday 28 December 2013. You failed to deliver. You would not then agree to deliver at a time which was convenient to me, and delivery was rearranged for, and took place on, 10 January 2013 However, I incurred loss due to your breach of contract.
In addition, I also claim £100 for some having to reschedule time to wait for the delivery, phone, and compensation for loss of enjoyment and for inconvenience. This brings my total claim to £100. I look forward to a full and prompt response to this letter within 14 days. Failing this I will bring county court proceedings against you for damages, interest at the rate of 8% per annum and costs.
I look forward to your response within the next 14 days.
Yours faithfully,0
