  • Help please! I placed an order on 19 August, and paid £5.99 for next day delivery, as I needed the items for an activity the afternoon of the 21st.

I received an email on the 20th, stating that my package was out for delivery, and would be delivered before 9 PM. I was home the entire day... I didn't "pop to the shop" or anything else; I literally did not leave my house yesterday in case I missed the delivery.

I received an email at 9:15 PM, saying that the item had been delivered. I didn't receive a knock on the door, a card through the door or anything. It was after Yodel's operating hours, so I couldn't ask where it was delivered. Because my event was this afternoon, I took the morning off of work so that I could sort it out and get the package if it had been delivered elsewhere.

I eventually found the package this morning (the 21st), which was was shoved through the front door of the upstairs block of flats (I live in a Lower Ground Floor flat. It's clearly marked next to my door [the plaque says "House Number, Lower Ground Floor"].) I don't share a front door with them, and I don't have a key for it, so I had to wait until someone else was in to let me in to retrieve the package. I called SportsDirect, originally just asking if I would receive a refund on my £5.99 next day delivery charge, and was told that I "had nothing to complain about, because it was delivered next day" (even though it wasn't delivered to me!).

According to their terms and conditions on their site, [FONT=&quot]"Couriers will require a signature to ensure safe receipt of your goods. If you are not available to collect and sign on the courier’s first visit they may leave it with a neighbour, or in a safe place (i.e. hidden from sight and protected from the rain). A calling card will be posted through your door to let you know this has been done. If there is no safe place a calling card will be left with the courier’s contact number to arrange re-delivery. Our couriers will deliver until 9pm in most areas!"

    - No one signed for the package; it was dumped in the foyer of a block of flats that I don't live in.
    - I was available to collect and sign for it... He clearly just wanted to be done for the day and couldn't be bothered to go downstairs, so he just chucked it through the door. It's not a matter of not hearing the door, or the doorbell, as the lounge is directly next to the front door.
    - No calling card was posted telling me where my parcel was left.
    - According to my delivery confirmation email, it was delivered after 9 PM

I've emailed Sports Direct as I got nowhere with their customer service agents on the phone. What other recourse do I have? I know it's only £5.99, but really, it's the principle. They didn't hold up their end of the bargain, and they should pay.

Write them a letter... a real letter?

These companies might take a bit more notice of a real letter... but you are talking about Sports Direct.

Call it a letter before action if you like.

    Google that for samples.

However, having said all that, I'm not too sure that I would bother. ;)
  • Cheers wealdroam.

I'm not happy about having to take the time to write the letter, but it's more the principle of it. They would be pushing for the money if the shoe was on the other foot, and it's not right that they aren't held responsible.

Plus, their "customer service" agents were the rudest people I've ever encountered, and this is quickly turning into a personal vendetta just to get my own back!

And they of course know that.

You wont get anything if you don't write a letter.
  • Can anyone please advise.
I ordered a pair of shoes to the hotel that I am staying with 24/7 concierge at on 21/08/13 for next day delivery. It comes to 22/08/13 and there is no sign of the package. I wait another day (to now - 23/08/13) and still have no sign of the package. I phone up the company (Samuel Windsor) and they say that the courier company left a calling card and couldn't deliver. Strange that something couldn't be delivered to a hotel with 24/7 concierge!
I phoned up the courier company to ask about what was going on, and they said the delivery driver probably couldn't find the place. I said it was not acceptable and was told that delivery was rescheduled for 27/08/13 because of the bank holiday weekend.
I had ordered for guaranteed next day delivery on the 21st, and yet I have to wait until the 27th to receive my order.
What are my rights? What can I or should I do in this situation?
  • Try to claim back the extra you paid for "guaranteed" next day delivery.

Claiming for consequential loss under English law is (understandably) difficult.

Alternatively return the goods (or threaten to do so) under you statutory distance selling rights of 7 days.
  • I am looking for help...

I ordered furniture from homebase on 29th August 2013 and we were told that the bed would be delivered on 5th September (tomorrow) and then the matress on 19th September. We have since had a call today from Argos direct (aparently part of homebase) and they were calling to arrange a delivery date of either 12th or 19th September for the full delivery as they don't do split deliveries. On our reciept it states clearly the bed frame would be delivered 5th and matress 12th and then if these dates are going to change we will advise prior to your date - surely the day before is unacceptable uas my partner has taken a day off work for tomorrow and he is self employed so he can't just cancel the holiday now.

Where would we stand with this?

Thanks for any help you can give.

The first thing you should do is read the article linked to in the very first post on this thread.

    Here's the link again:
  • Thanks, I am calling homebase later so I will post how I get on with it.
  • So I thought I would save some money and order my children's sxhool tshirts and jumpers of new embroidery service at tesco , online it said that it would be a 14 day wait, so I ordered on the 11th August, leaving plenty of time for it to arrive... Well so I thought! Come 26th still hadn't arrived but had received an ema saying that they were currently out of stock they will update me when back in stock so I phoned them the 27th to enquire and was told that they will speak to the company and put a note on my order. Another email received 29th to say delay due to stock will be dispatched 29th 30th and will receive either 30th or the 1st...
Still no delivery. Yet again another email received on tbe 1st to apologise for delay my order has been made priority and will be stitched and dispatched and definitely will be here Wednesday. Well Wednesday came and rung them again to check had definitely been dispatched. . Low and behold it hasnt. So I had to go out and spend double the amount that id spent on tesco to buy them jumpers and tshirts. .. so am now out of pocket still waiting for my delivery. What rights do I have regarding this as it isnt acceptable! !
