So I thought I would save some money and order my children's sxhool tshirts and jumpers of new embroidery service at tesco , online it said that it would be a 14 day wait, so I ordered on the 11th August, leaving plenty of time for it to arrive... Well so I thought! Come 26th still hadn't arrived but had received an ema saying that they were currently out of stock they will update me when back in stock so I phoned them the 27th to enquire and was told that they will speak to the company and put a note on my order. Another email received 29th to say delay due to stock will be dispatched 29th 30th and will receive either 30th or the 1st...
Still no delivery. Yet again another email received on tbe 1st to apologise for delay my order has been made priority and will be stitched and dispatched and definitely will be here Wednesday. Well Wednesday came and rung them again to check had definitely been dispatched. . Low and behold it hasnt. So I had to go out and spend double the amount that id spent on tesco to buy them jumpers and tshirts. .. so am now out of pocket still waiting for my delivery. What rights do I have regarding this as it isnt acceptable! !
Your query doesnt relate to delivery rights

This thread us about the delivery process, you are talking about the supply chain failure.
But we always welcome first time posters and I have a financial relationship with Tesco, so I am interested in finding out if Tesco has over reached itself (again?).
So if you post a link (you will have to take out the http stuff because at the moment the system thinks you are a spammer - probably try double spacing the link and take out all the http stuff just "x y z dot c o dot u k (or what ever) should do it.) I will check you link for you and repost it if your story appears to stack up.
Under English law (now tell me you are in Ireland/Scotland) time is not "of the essence" unless you make it so BUT someone offering "a back to school" service has broken its contract, morally if not in the T&Cs. So cancel and raise a dispute if you don't get you money back (if you are the sort to stand up to this sort of treatment).
You might get offered a bit of compensation;) though the company is unlikely to be liable for your consequential losses.0 -
On t he first phone call I asked if would definitely be here by next week as kids had school Thursday and she said yes it would then all other emails etc...
Ups were ment to be delivering it.
They should have been more prepared as obviously many parents would use it as it's cheaper but doesn't actually end up cheaper as paying it twice!
Am going to ring them again now and see what they have to say.0 -
hi,
can someone give me some advice please
i had an order with gear4music.. delivery was paid for at extra cost for garaunteed saturday delivery with TNT
TNT didnt show - the slot was 9-6 but the driver left at 2 due to bank holiday.
This was then arranged that i would collect from depot on the tuesday morning. When i arrived they had sent the items elsewhere and i had to return again tuesday night.
once received and inspected the goods they were inadequate so i arranged for them to be returned.. I had to take another day off work on the friday for collection.. They never showed so had to take another day off on the monday where at the last minute they turned up.
My contract was with gear4music.. they have had the complaint letter and not yet responded
TNT have contact me though as have seen a copy and offered £30 in vouchers.
my letter claimed for £225 for 2 days off work, plus travel and collection.
Should i accept TNTs offer and pursue gear4music for my claim or should i decline and fight for more appropriate level.0 -
I wondered if anyone could help with this.
I made an order with Approved food on 31/08/13 and received an email on 3/9/13 to say that it would be dispatched on Weds 4th Sept.
I took the day off and waited at home but by 6pm nothing had arrived so I called City link who apologised and took extra details to help the courier in finding it on the Thursday redelivery.
Thursday, I took another day off (unpaid) and by 12noon nothing had come so again I called City Link and they assured me it would be with me by 2.40pm. 3pm comes and still no parcel. I call back, more apologies, I reconfirm all address details, my phone number for driver etc. and I'm told I'll have parcel by 5.30pm.
6pm - no parcel. Angry phone call to City Link - spoke with escalation team who apologised, assured me I'd have a call in the morning with a delivery time.
So I took Friday off - UNPAID! They call and tell me I'll have it by 12:30. Sure enough, it finally got delivered at 11.52am.
City Link have since apologised and told me to claim from Approved Food for consequential loss and they will refund Approved Food the delivery cost.
I have called Approved Food today and they say their terms and conditions mean they will not cover consequential loss at all. The particular part that refers to it is this:
"Approved Food, any other party (whether or not involved in creating, producing, maintaining or delivering the Website) and the officers, directors, employees, shareholders or agents of any of them, exclude all liability and responsibility for any amount or kind of loss or damage that may result to you or a third party (including without limitation, any direct, indirect, special, punitive or consequential loss or damages, or any loss of income, profits, anticipated savings, goodwill, data, contracts, use of money, or loss or damages arising from or connected in any way to business interruption, and whether in tort (including without limitation negligence), contract or otherwise) in connection with the Website in any way or in connection with the use, inability to use or the results of use of the Website, any websites linked to the Website or the material on such websites, including but not limited to loss or damage due to viruses, worms, Trojan horses, logic bombs or other malicious or technologically harmful items that may infect your computer equipment, software, data or other property on account of your access to, use of, or browsing the Website, or your downloading of any material from the Website or any websites linked to the Website."
Does this mean I took 2 and a half days off work for nothing???
Is there anything I can do??
Thanks0 -
Does this mean I took 2 and a half days off work for nothing???
An important point to remember is that you planned to take one day off for the original delivery, so your loss is really only one and a half days.Is there anything I can do??
Have a read of that MSE article linked to in the original post on this thread.
To save you looking for it, here it is again:0 -
Help! Really losing my patience with an extremely unhelpful furniture company!
My partner ordered a wardrobe in June (yep, 3 months ago!)
There was no indication that the item was not in stock or that there would be a waiting period when we ordered but the next day we received an email informing us they were waiting for the shipment and that it would take 5 weeks for delivery.
Whilst not overly impressed we wanted the wardrobe and so didnt not cancel.
We waited the 5 weeks only to them receive an email stating that it would take another 5-8 weeks!
Again we were not happy but, having waited this long we still did not cancel the order.
The order was delivered last week- well half of it was!
Whilst the delivery men were building the wardrobe they realised that the back was not actually in the van. They arranged for the back to be delivered on Saturday and whilst they were with us discovered that the lock was faulty and so they said they would send a new lock.
The missing back had caused the door to droop ever so slightly and had scuffed the (silver leaf) finish so they also noted on the form that the damage would be repaired.
On Saturday evening someone came and put the missing back onto the wardrobe and tried to fix the lock (without the correct tools- he had to borrow our screwdrivers!)
The lock could not be fixed but, as instructed by the first delivery men he had bought a spare!
This also didnt work!
He painted over the scraped wood with a special paint, left the lock off and said he recommended I ask for a replacement and would inform the company what had happened and get them to contact me.
This replacement was now necessary as he had made a complete mess of painting over the damaged part.
This afternoon I called the company as I had not heard anything and they proposed delivery of a replacement.
I requested compensation for the inconvenive of waiting for an additional delivery they flat out refused and so I took an email address in order to put it in writing.
I quoted the failed delivery laws as shown in the guide and also time is of the essence (it's been 3 months and 2 wasted deliveries already)
The response refused "a discount" to which I stated that I was not requesting "a discount" but compensation.
Again they flat out refused.
My partner works two jobs, one of these as a teacher so he can't just take time off.
I live 45 minutes away and am currently recovering from cancer- time and money are very precious to us and we can't really afford to keep wasting it on this awful company.
Big problem is- we want the wardrobe! (Not the faulty damaged one, but a perfect one like we ordered and paid for)
Can anyone advise what to do next?
I feel like the company are being hugely unreasonable- they basically keep telling me I'm talking nonsense0 -
Well you are entitled to reject the order for a full refund. Personally that is what I would do. However even if you want to keep it, given the choice of a full refund or a small compensation the company may reconsider.0

Thanks for replying!
It's one of the cheapest places to buy it from and I think that's why he's being so stubborn- if I cancelled my order id have to pay more to buy it elsewhere.0
