[ seven of the doctors have been under investigation for more than seven months / another five were placed under investigation this year following complaints about their conduct, mostly relating to allegations /concern about the treatment of vulnerable people ].

  • I'm still bit confused but nothing new there then!!! i was in group i think had to go job centre have regular interviews all of which waste of time had to fill out medical form yet again not heard last two times as my conditions still the same well worse but hey ho. Well this am (sat) received letter to say i'm in the support group but dated till nov this year my dla gets renewed next nov as they keep giving me two years.
    The confusion is what does that mean it will stop in nov or I'll have to go medical again only filled out form end may they seem to be doing every 6 mths any advice welcome, its for contribution i think dont think income based as never filled anything out about money etc

    sorry for being bit thick but at the moment things arent adding up in my head unless explained simply

    Unlike DLA which is ofyen for a fixed period, ESA continues until you are no longer eligible, the date in November is aparently because of the £10 Christmas bonus. If you want to know your likely re-assessment date, request your medical report from your local DWP office, the prognosis date from the end of the report is usually what is used.

    You keep saying this on various posts and it is incorrect.

    Everybody in the WRAG will get 12 months on ESA(CB) before losing their eligibilty. as the person referenced is currently on IB their 12 months will start when they are transferred, it is only if you have already neem in the WRAG for 12 months on 6/4/11 that someone would lose their ESA(CB) eligibility immediately.

    those who have other household income that wont qualify for esa any more, if their cont based esa stops and that means the household is then struggling wouldnt that reassess them for tax credits? because cont based esa was taxable anyway.
    i cant say i disagree with whats being done, i think it will make a lot of those who could possibly manage to do some hours but dont because they can get as much on esa now go and do them!
  • i would work if i could. my con esa buys our food and whats left goes on petrol for OH car. his wages only just cover household bills. when i lose my money i wont be getting a job... 1 wont manage and 2 my disability does not make me attractive to an employer- they would have to make too many allowances for my condition......
  • but thats one of the points im making. if your OH income is low and your contribution based esa stops so total income has dropped wont you now be eligible for tax credits?
    if it affected me which fortunately for me it doesnt then thats what id now be looking at to see if it covers you from that angle....

  • I would like to tell anyone who's been getting sick pay (SSP) and is near the end of the 6mths (I think it's 28 weeks) some useful information.

    When my SSP finished I had to claim ESA - they told me about the "3 day rule". I said but I lost the 1st 3 days at the beginning of my SSP. They also told me i had to have a 13 week assessment phase at a rate which was lower than my SSP. I had a great advisor at the Maggie Centre I was attending.

    Some people dont know you are entitled to ask to be placed in the WRAG group IMMEDIATELY until a decision is made as to whether you do or dont have limited capability. Why should people who've been off work 6mths have to wait another 3mths for some pencil pusher to decide what their capabilities are? Is that not what their own doctor is for?

    I speak from personal experience - breast cancer which has spread to my lungs - difficulty with my breathing affects everything I do. I get contributions based ESA and I'm in the support group. Yet I had to quote the ESA Act to staff who just kept telling me i had to wait 13 weeks - thank goodness for the training The Maggie Centre gives their staff.

    I got my claim backdated to the START of my 13 week assesment (which actually lasted no more than 3 weeks).

    Yet funnily enough I received a letter last week detailing my ESA, it also mentioned that if I was NOT on contributions based ESA I would get nothing. It confirmed my Support Group status and my weekly allowance of £99.85- it detailed benefit total and told me I'd be getting a £10 christmas bonus, yet dates for benefit payment were listed to November 28. Is this the date all the letters go out re 12mth rule?

    The mention of this date confused me and I was going to phone them but i suffered a blood clot to my lung and i'm just out of hospital - thankfully the A&E consultant I got knew the symptoms so he saved my life! Just another thing to add to my CV of life.

    I will wait and see what happens at the beginning of December.
  • i think that is saying you will be entitled to the xmasbonus if still claiming on nov 28th, as i know theres a set date around then as to whether entitled or not.

    well I got my letter today, im in the work related activites group of ESA have been for over a year so if the law gets changed my ESA will stop imediately.

    Im really not sure what they want me to do, I cant drive out of my own town, I cant walk further than 30 mtrs, I cant concentrate for more than about 20 minutes, I have a self propelling wheelchair only on the stipulation I do NOT wheel myself, I cant stand for more than 5 minutes and cant sit for more than 10 minutes, I have a reclining chair that i sit in as its the only type of chair that takes the pressure off and limits the pain. I have constant shakes, i cant hold things as my wrists give way, i have memory lapses that make me dangerous to myself (like forgetting things in the oven are hot and taking them out bare handed) But im fit to work, my 12 months are up and theres nothing I can do about it as no one problem is on their 'support' list, they dont look at the whole :(

    But just to make me feel better at the bottom of the letter 'you may be entitled to income related ESA' but no information of what the rules are to fit this!!
