  • As for the game. If you bought it as new, how would you KNOW it was new? You couldn't.

The same applies to a lot of things you can buy so what are we going to do now have a philosophical debate on what the word new means?

If the OP purchased it new from the supermarket and never opened the case, it's still new isn't it? You may not know where the supermarket got it from but considering one distributor occasionally reseals damage stock and just sends it back out again the item being sealed doesn't mean it's new either, ironically the only way to know is to remove the cellophane and look at the disk...

Also as someone said earlier u can buy the stuff to seal the dvds/games back up so anyone could pass used items off as new then if they wished and us as buyers would have to take there word for it

As certain sellers on Amazon do with rare titles, same used to happen with videos as well.

Th ebuyer expected a shrink wrapped game as that is what the 'new ' condition on ebay tells them to expect. This crops up time and time again- the big game sellers have tried arguing with ebay about the condition explanations but nothing has changed.

It is worth noting that if you sell a game as 'new;' buyers are told the following:

    Condition

    New
An item that is still in its original shrink wrap from the manufacturer and the original manufacturer’s seal (if applicable) has not been removed. See the seller's listing for full details.

Keep an eye on your expanded seller dashboard, th ebuyer might hit your description stars - but it is worth an email to ebay adding your comments to all the others about ebay misdescriptions.

If you sell any more though you might avoid problems by stating in the auction terms itself that game although new is NOT shrink wrapped.

Ebays version of new is clear.

If you then stated new but Morrisons don't shrink wrap, then that would be fair enough.

    But you didn't.

So if you bought something as 'shrink wrapped' and it wasn't. You would be worthy of a dispute/giving a negative. Would you not?

eBay's version of new is based on a the US market which has been applied to the UK specifics without thought. Seeing as certain titles are not manufactured in shrinkwrap, how do you propose they be sold on eBay? Not to mention is says 'if applicable'.

There is no point in the same argument,i cant remember in all the games/dvds ive bought from stores or on the net over this last year have been sealed maybe 1 or 2 out of the 20 or so ive bought and again as i say i didnt know that ebay automatically put that into your listing until checking the listing back over earlier and someone mentioning it on here.i didnt think for one second someone would come back and say its not new as its not sealed im used to buying alot of stuff unsealed

    It matters not.

If I buy on any website which says shrink wrap, I expect shrink wrap....for the very reason you yourself explain....

    What reason?

eBay don't put it on. You select it, as you did for this listing.
