Why should a buyer be out of pocket because a seller doesn't list something accurately?
I bought a pair of shoes described as "New, without box". What arrived were shoes that had clearly been worn because there was muck on the soles and the printed details on the inside had significantly worn away. I'd been charged £12 for the shoes and £5 postage. Seller argued it wasn't worth sending them back at that price, but I did, filed a claim and got back the £17 I'd paid him plus the £4-something it cost me to return them. He argued they'd only been worn in the house, but worn they were and so they weren't as described. Why should I have been out £9 for a lying seller?Science adjusts its views based on what's observed.

Understood but he was offered a refund,what can i do if he declines then swears at me,maybe if he had of said no but i will take it up with ebay as to who is responsible for P+P (which by the way i thought was him) then i would have agreed to a full refund upon knowing who was,its to late now he's left feedback and dont look like he will retract it,Neg is harsh for a game he got cheap just because it didnt have a bit of cellophane on it.TBH whenever we have bought games they rarely come wrapped so didnt think it would be an issue
The price is immaterial. Bargain or not. You did use the eBay description of NEW which states sealed. It was not. You should have used NEW OTHER.
You are responsible for the outward postage but not the return unless you are a business or have morals that think you are as a private seller - that isn't a dig.
Neg may be harsh but buyers act in the heat of the moment whilst buyers repent. Fact of eBay.
Perhaps put yourself in the buyers shoes.0 -
I understand that but he should have been a bit more polite about things instead of being a complete a**e,there was no need for him to be funny in the first message,he wasnt interested in resolving the problem just swearing at me.i wasnt aware about the P+P until i came on here by then the damage had been done. like i said the game is new, most games/dvds arnt sealed these days and i never noticed that ebay automatically put about it being sealed until i checked the listing back earlier.first time ive ever sold a game else i would have known about the automated ebay problem for people selling games/dvds new but not sealedchancesare wrote: »The price is immaterial. I agree a buyer shouldn't be out of pocket but a seller does not have to pay return postage.

There isn't 'new other' in media. From what the OP has stated there is no suggestion that the buyer is questioning the wording on the listing next to the item specific, more the OP's choice of the word 'unopened' which is technically correct if they never opened the case but obviously open to interpretation. The majority of these complaints come from the misconception that all media is sealed.
In the days when supermarkets kept their DVDs behind the counter a 'new' DVD from them could be covered in finger prints and scratches!In the game of chess you can never let your adversary see your pieces0 -
