You've totally missed the point. It's not about how Ryanair's all-in fares compare to its competitors, but about Ryanair misleadingly advertising fares that are cheaper than its true all-in fares by excluding additional fees that cannot be avoided.
Given that Ryanair's new card will not be available on an instantaneous basis, the resultant all-in fare is higher than the advertised fare. Either the customer pays the card surchage or waits for the Ryanair card during which time the fare goes up. In either case, the customer pays more than the stated fare. This puts Ryanair in danger of breaching Section 5 subsections 2 and 4(g) of the Consumer Protection from Unfair Trading Regulations 2008.

Person B may wish to obtain the card and avoid the fee, but does not receive it in sufficient time to pay for the flights at the stated fare before the fare goes up. As already explained (see above), there will be an inevitable delay between ordering the card and receiving it, during which time the fare will have in many cases increased above the stated fare.
That is just hard lines for person B , they should have ordered it earlier.. Life is not fair. Those in the know and prepare generally fare better than those who don't know, and don't prepare.

The issue is not with your "Person A" scenario but your "Person B" scenario. Person B may wish to obtain the card and avoid the fee, but does not receive it in sufficient time to pay for the flights at the stated fare before the fare goes up. Hang on here, person B can avoid the payment fee by applying and waiting for the card then buy their ticket. If person B wants to buy immediately and has not got the fee free payment method, they will have to pay the extra £12, how hard is that to understand?
I got stung on the London Underground the other day by buying a single for £4 instead of getting an Oyster card and paying £1.90. Do you see me whinging on an internet forum about my unpreparedness?0 -
Yes, it is "hard lines" for Person B, which is prohibited by Section 5 subsections 2 and 4(g) of the Consumer Protection from Unfair Trading Regulations 2008. Before a consumer has made a decision to book a Ryanair flight, why would they have already obtained a Ryanair card? As soon as the consumer makes a decision to book with Ryanair (as opposed to another airline), the consumer will want to go ahead and book the flight(s), but cannot do so at the advertised fare, either because they have a to pay a £6/flight surcharge or they have to wait for the Ryanair card to arrive during which time the fare is likely to have increased.
