    Best check with his union rep then who will actually KNOW rather than trying to recall (possibily out of date) info from some time ago.

    I don't work for RM but my own company has a policy that they need to be advised only if there is any conflict of interest-Most places I've worked for are the same policy.

    Yes - but we are not talking about a second job - he is working during hours when I can only assume RM staff are normally at work. There certainly are rules about having two jobs at the same time. Being suspended isn't permission to go and work for someone else.

    Hi there,

    Thanks for all the replies.

    He isnt actually working the same hours at the moment as he would be at RM as he is a night worker so there is an overlap of 2 hours from 4-6 am but that's it.

    I will get him to ring his Union Rep when I get home.

    In which case he is not availiable during the hours of work as per his employment guidelines. The second job thing is secondary.

    I'm not sure he can resign? (I don't know). The other job will be subject to references - so you need to know the outcome of this before he can start I would assume?

    Agreed. If he is caught he will not only be up for dismissal for this (assuming the first charge doesn't get him) but he will also be required to pay back the money that he is defrauding from the RM. Sorry to be so blunt - but this is fraud. He isn't available to work those two hours because he has a job during them and he is already being paid for those hours, and the fact he is suspended isn't relevant.
  • I can't read through the whole thing but we are assuming that he has been suspended on full pay of course...

    He has rung the Agency to tell them that he cant work for them until he has sorted the RM situation out. So he has only actually worked 2 hours that he should have been available for RM. So no harm done. Thanks for all the help on here on avoiding another potential disaster.

    Better safe than sorry.......:o

  • Firs of all I really feel for you and all you are going through. Hang on in there girl.

    As for your Partner, there is lots of talk of settlements etc. but his Employer has the upper hand, he has committed two acts of gross misconduct, a) drugs and b) agression. Either of which is dismissable, put together, he hasnt got much defence.

    Personally, I would advise him to throw himself on his sword. Agree he doesnt want a Tribunal, is willing to sign a CA not to take it further. Show them proof he is loooking to clean up his act GP's appt etc. say he has had problems in the past, learned a horrible lesson, plus has a totally innocent partner and two kids and will need future employment. Just say he has learned his lesson the hard way, and anything they (and the Union) can do for him now, is better than what he has got. The Union may have access to welfare rights info. etc.

    Yes its a blow to his pride, yes its grovelling. But to be honest there isnt much else he can do. If he really has changed he will have to do this at some stage.

    To all those posts who want the agressive, give me money approach, I just can't believe you !! Its the Post Office..............do you want your post sorted, delivered by someone who isnt fully compos mentis ? Would you want to be attacked by your postman 'cos you challenge his judgement. GET REAL !! There is enough on here about shoddy service and poor delivery !! As for a reference............would you employ this guy on a Fork Lift Truck in a Warehouse? driving a delivery van ? C'mon his Employer has a duty of care to future Employers. If they can give a blanket, means nothing reference it's the best he can hope for.
