    Can he get back on to his agency now?

    I suppose the only thing now is to move on and trust that this has taught him the lesson that he needed and that it won't be forgotten. It's a hard way to learn, but sometimes it is what is needed. And if the drugs had such an effect on him that he acted agreesively and out of character with a colleague - it could easily have been you or the kiddie. So here's hoping that it will be the turning point.
  • Sorry the outcome was dismissal, but at least he knows and can move on now. Its important he seeks all the help he needs and doesn't let this set him back with coping with the addiction xxx
  • I've been following this thread for a few days now, but haven't contributed as I've had nothing constuctive to add. I'm sorry for you and your kids he's been dismissed, but at least its no longer hanging over you now. Fingers corssed this is the boot he needs to sort himself out for you, and the dismissal doesn't set him back.

    Hope you are o.k, I know its horrible but it gets easier if you have an action plan depending on your circumstances. All he can do now is look to move on to whatever is next. Can you get some type of reference off the old employer? Also whilst hes sorting himself out and not in work he needs to look at what benefit hes eligable for.
    When I was dismissed I got JSA straight away, but I know some dont. I hope he manages to get something elce soon.I think its really tough getting a job now because of the awful job situation. He cant get into a mess like this again because 2 dismissals would be really difficult to explain.
    I try to be positive because I know people who have done long prison sentences and then have got jobs and have done well.

    Did he have a case statement prepared? Is he appealing the outcome?

  • He's not appealing the outcome as he doesnt think he has any grounds to. At the end of the day he smoked weed at work and pushed his manager - what company wouldnt sack him?

    He is still clean which is fab and he is working really hard to get something - he has signed up to all the agencies and I will ring up the tax credits people tomorrow to see whether they can offer some help.

    Off to the frugal living board I go!

    i wouldnt expect him to win an appeal
    the RM appeals procedure is pretty much looking over the facts to ensure they have done everything by the book and would win a tribunal
    The only time i hear of appeals being won now is where the person or union comes up with a failing on RMs part

    Were there perhaps procedural failings during the suspension process where the suspending manager failed to involve a union rep? (the policy seems to suggest this should happen).

    Was the suspending manager subsequently involved in the investigation or disciplinary process?

    There may be grounds to go to appeal especially since at this point he has nothing to lose and possible reinstatement to gain.
