Help! How can i get a refund from internet firm aston experience who arent replying?

  • Just thought I would post an update:

    It has now been 18 days since my refund was allegedly "processed" by The Aston Experience and 13 days since it was due to be recieved by my bank. Still NOTHING What a COMPULSIVE LIAR!! I knew this would happen so thankfully I took the initiative to start the chargeback process on day 6.

    I am glad to report the original outlay PLUS interest has been credited to my account by my bank and they will know persue these scammers.

    Fellow Victims: you all have a case against this SCAM/SHAM, contact your banks for refunds.

    Do not be strung along by their web of lies and stories. Nothing but Compulsive Liars.

    Oh no!
    Bought a deal from Wowcher, £225 for a day etc.
    I've emailed, phoned, left messages but had no replies and now my wowcher is shown as redeemed!

    To add insult to injury, the web site is down. Does anyone have any PERSONAL contact details for this firm or Adrian?

  • i have had an email today from the official receiver informing me that adrian of aston martin experince was declared bankrupt march 21st 2012 and that as a result no experiences or race days booked will go ahead.websites and all links to it have dissapeared.

    I have also been taken for a ride by this crook. I contacted Adrian in September to book a "Surprise the Groom" Deal for my hubby-to be (the wedding is in 3 weeks!) I paid him using my credit card but via pay-pal to his pay-pal account on his advice "so that I would be fully protected and could have peace of mind" this was the only payment option I was given and that he said was available - Only problem now is that I’m worried that my credit card provider wont refund me under the chargeback scheme as I paid via pay-pal...found some stuff online today which says that the bank doesn't have to refund me if I used a "third party" to make the payment?! Does anyone have any advice on this?

    I have been in contact regularly with Adrian and he has not once indicated any problems with anything. I even e-mailed him the copies of our licences yesterday morning and got a reply from him saying all received and thank you!! Then later THE SAME DAY I had the e-mail from the Insolvency Service saying he had been made bankrupt and my hire would not be going ahead. I am gutted!! :(

    I always always research people and companies before booking and at the time the only things i was able to find negative about the company was two bad reviews about Groupon deals...i asked him about it and he admitted he had had problems with the groupon deals, too many had been sold and some customers had wreaked the cars. He promised I would not get the same thing happen to me, and promised that he would make my wedding really special!! :mad:
    I have sent him one last e-mail which i hope got through before it was turned off telling him exactly what i think of him. I also have his mobile number so a few phone calls in the small hours may be in order! Childish maybe but i think i'd feel better! :p
  • CountryGirl230972: You need to phone you credit card company (phone number on reverse of card) and explain the situation.

    It seems to be a grey area with respect to PayPal payment processing...but i think you/we should be OK as we did not "checkout" or purchase the service from Paypal...but we made a direct transfer to his account....

    Eitherway, you most likely will not be able to do a chargeback now, but Section 75 will hopefully apply - you might have a fight on your hands.

    Luckily i did my chargeback in time and it looks succesful...even though the scum bag contested it and i had to fight the comeback....perhaps it was me that sent him bankrupt? :rotfl:

  • Thanks one_post_only, I will contact the card company and see what they suggest. I didn't know there was a time limit on chargebacks...do you know how long it is?
    Just been reading up on the Section 75 info...it does sound like this is more the option i should take, just the pay-pal issue which is a bit foggy, but like you say I just paid him the money via pay-pal...and his pay-pal account was in the name of the company so fingers crossed!

    Yeah I looked up his Insolvency when i had the e-mail. I didn't really believe it was real until i did that!

    I would be up for contacting Rogue Traders, I'm sure he will pop up again in a few months time with a new business and so it would be great to get his face on national TV so others can know to avoid him!
  • Just been ripped off by the guy too. Ive had Astons from him in the past and all was good but this time hes gone under taking with him over 3k of my cash. Not too bothered about the money as I put this down to an expensive lesson learnt from a stupid mistake. Ive been in touch with countless other super car hirers so I can get a motor for when I get back from South America and he owes them a lot of money too. Does anyone have his address or does anyone know where he may be found. I plan on seeing him up close and personal when I get home.

    A Section 75 claim is unlikely to be successful.
    There needs to be a direct debtor-creditor-supplier link, and with Paypal involved that link is broken.

    MSE's Section 75 Refunds article has this to say on the subject...
    You're usually unlikely to be covered when payments are made to a company that isn't the one providing you with the good or service because the credit card company must have a direct relationship for them to be equally liable. The first main area is paying via an online processer such as PayPal, WorldPay or Google Checkout. Though these can have their own refund systems, they aren't as strong as the legal protection of Section 75.
    There have also been recent cases where people buying goods on Amazon through other suppliers, have been turned down for Section 75 claims by credit card companies. Much opinion is these SHOULD be covered by section 75, but it may be a fight to make it happen.
  • i too have been ripped off by this crook.upon further investigation i have found that his company "the aston martin experience",was dissolved on august 23rd 2011.i have been informed that he only had one car that has now been repossed by the finance company.all other cars were hired in then subhired again.seven years were spent saving for this booking.a dream and hard work desrtoyed by this person.i too paid via paypal with a credit card.paypal state they cannot help only enter into negotiation.my credit card company is now handling it and i will post back with any results.i am imformed that he has no assets and it is highly unlikely that after investigation any divedend will be paid.also as he has been declared bankrupt any private claims against him cannot be made.all his accounts and contact details are available freely on line.thinking back now,was the booking to good to be true? Yes it was.also the pressure to pay as quick as possible to get the best deal.very convincing but playing with peoples dreams and live is a step too low.
