I have to consider the morbid thought that if I'm very ill as opposed to pretty ill that I may just get dad to give it all to SB. Otherwise if it comes to me and I die then 40% will disappear to inheritance tax straight away.
Can it be given to SB with you as the POA for now?

Do you have a friendly lawyer you can talk over this money issue with?
I am guessing that your dad is fairly elderly hence the quandary of what to do with the money? Ie he could give some money to both of you now, IF you knew that he would last 7 years to avoid the inheritance tax.....
What happens to the rentals by the same token? I am not sure I know how old SB is. Would he need a guardian for the money/rental properties?
And yes it is a bit morbid thinking about all this, but FAR better for those left behind that it IS sorted now, in the best way possible, then for it to be a mess to sort out. And extra taxes paid because of this.

It's surreal Beanie...I feel very detached at times because it's too much to take in. I don't think it's in my liver, I think my livers messed up a bit from the first chemo and that's why the test results are so flaky.

Oh Moo I don't know what to do. SB's a wee angel and he'd do exactly what was needed. It's a wait and see on Monday decision. It would let me pay off the mortgage and have a wee bit left or pay off most of the mortgage and have enough for a year.
My main stakeholder texted me today to say they missed me and really wanted me to come back. It was so nice and unexpected.

I have a POA and will in place from last time. SB is fine and in trusteeship until he's 25. Both POA and executors know my wishes. SB and I wrote the trusteeship clause together because even more morbidly if he dies after me but before he's 25 then the estate reverts to me. We chose the second line beneficiaries and charities together.
Dad's estate is also find as it's well under IHT. He asked me to pay my brother half of the value in cash last year which I did. House devalued again so I get less than him - crappy position.
I'm firmly in IHT territory and it will be paid from my estate. However as the house was sold yesterday money hasn't cleared solicitors yet. If this is terminal then option would be to bypass me completely and it all go to SB with no IHT implications. Only my current value would be in question which would reduce SB'd IHT bill by £50k.
