While I agree with your Double standards and having your cake and eating it phrases, I wonder why is it then, that no one ever comes up with a store refusing to refund or exchange "sealed" items...maybe its because, its custom and practice to do it, and maybe even, that there is a deeper policy on this, which CS have been told about.
I've tried to find and example where it says "these items will not be refunded on", but all I can find are these 2 statements from Tesco.com and Tesco.direct.....
"We may restrict the exchanges of CDs, DVDs, videos and computer software to the same title due to the problem of unlicensed copying"..
"CDs, DVDs, videos and computer software, which may be restricted to an exchange for the same title due to the problem of unlicensed copying;"
As you see both of these statements include the words "may be restricted".......maybe the explanation for these 3 words is "if unsealed"
I cant even find a copy of what it says on the blue instore policy board.......but maybe the board wasnt big enough to describe the policy in full.

I went to tesco the other day and brought a box of uncle bens rice, the HUGE sign hanging from the ceiling said buy one get one free, so I picked upi another box, there were no SELs so I went with the HUGE sign. Got to the till, was just about to walk away when i thought i better check my receipt, guess what, i had been charged twice. So i went to customer services an the manager came over and said that the HUGE sign was for a deal that finished the day before and the rice was there for a deal that started the next day. I was really tired after a 9hr shift on my feet so didn't really bother to argue too much, just got the refund, but didnt get to keep the rice, should i have argued more? COuld i have mentioned trading standards?0

Wonder if she knows that the refund policy she was confidently promoting gives Tesco the excuse to accuse its customers of deceit when they dare to complain that they have been overcharged or to give silly excuses that the policy does not include when you have been overcharged due to reasons x, y or z! Don’t think these would stand in Court when no such disclaimers are included in the policy quote!

“Prunella Scales is thought to have earned more than £1million from her role in Tesco's advertising campaign as the elderly bargain hunter Dotty Turnbull. She helped Tesco become Britain's biggest supermarket chain” …………….. but does she know that customers trusting in the advertised policy are being slandered and banned and called thieves as the result of expecting the refund policy to be applied without discrimination to themselves in the event of a mere Joe Bloggs being overcharged?
Really must ask her for a comment!!!

You could have mentioned training standards, but all the evidence would have been removed before anything could be done.
Regardless of whether the offer was out of date, that was the offer that induced you to buy the product, because of this you were overcharged, and because of this (again) you were entitled to your money back and also keep the goods.
Items on the shelves "are for sale" unless otherwise stated.
It is against the law not to display a price for a product, and the offer you saw should have been the offer you were sold, as it wasnt you were overcharged.

Does anyone 'in the know' know whether this policy is actually at the manager's discretion? Surely if the sign was up then they should have R&R'd in line with policy...
I don't understand how some people can get expensive items like TV's and iPod docking stations, and yet that manager was too miserable to R&R the rice.
Surely they should make more of a fuss over the more expensive items?
BTW I looked in my local Tesco and the charter near CS desk has the policy there large as life.. no other trace of it anywhere instore though!0 -

No, it isnt at the managers discretion, although some stores use this excuse.
In the past when overcharging has been admitted, but the refund was refused because "it is at the managers discretion", these have been turned over by HO, and RandR given..........but often accompanied by a store ban from the "bad losing" manager.......I've had two such bans, after HO overturned store decisions.
Some stores play the game, and after(usually) checking with HO, will refund even large items.
Other stores fight tooth and nail for pennies.
Re policy instore....you may find that there is also an A4 notice on every till.Couponing....."every little hurts"

No way? surely this could be appealed to head office also? That's outrageous, if you were abusive or shoplifting, definitely ban you from the store.. but for exploiting a loophole? Shame on them.
I think the penny has just dropped though... I've been looking for the mis-prices others post as well as trying to spot my own, but never seem to see the mis-prices which have been reported. So maybe a mis price is very localised to the computer system in one store? I thought a mis price would be national.
(Please don't let this start off a birrage of 'don't be looking for mis-prices it's wrong' because I'm not interested all of you people who think you have better morals than I)0 -

We've discussed the second of your examples on and off for 5 months or so.
We've also tried to find the actual Prunella Scales advert, but IMHO, Tescos have bought this, and removed it from public view. It was advertised some time ago, but all traces of it seem to have disappeared now.
We discussed how we could use it, but would a 10 year old advert carry any weight?
