Hi
I was discharged from bankruptcy in Dec 06 and I have decided to go ahead and try and claim they charges back. I looked on the Consumer Action Website and they seem to think that yes you can.
I sent my first letter off to HSBC today for about £1200 worth of charges to claim back, will see what they say! You could always argue that due to the charges, it helped lead you into bankruptcy!
Hope that helps

Hi,
I was declared bankrupt in 2003 after losing my employment. My bank charges built up and was deducted from my sick pay thus all other charges built up. I have now provided my case based on the charges that Lloyds placed on my account were before my income was stopped and as such were paid by my income at that time and not part of my bankruptcy.
Hoping that made sense to someone.
Either way just claim it as you have lost it anyway and if they pay a bonus.0 -
I was declared Bankrupt in Feb 2006, been discharched for 3 months. Put in a claim to re-claim my £3800 from Natwest and yesterday received a letter saying as a gesture of goodwill they will refund me.So to all those in the same position - GO FOR IT!0

Hi can anyone help? I am in the process of being declared bankrupt. I wondered if I can still claim bank charges from LLoyds tsb as one of my accounts with overdraft was with them? I have opened a parachute account which is what I am currently using. Thanks0

I had to go bankcrupt a few months ago and was left owing LloydsTSB £400 from my current account. I looked online and worked out they owe me over £1000 in charges so I sent them a letter with the details. Could they take their £400 and give me the rest........?
Since then my account has been closed and I cannot access the statements online anymore.
They sent me their standard letter back saying they were sorry if I was unhappy and if I haven't already done so to order the statements from them.
If I take them to court do I need the paper statements as proof even though I have already provided LloydsTSB with exact dates and amounts?
Is this a standard letter??
Please help me before I proceed to the courts (if I should)!
Can I still claim as a bankcrupt?0 -
Hi everyone! Just to let you know, my previous message was all jolly and happy, due to the fact that Natwest had offered my Bank Charges back as a "gesture of good will" even though I'm a discharged Bankrupt. I spoke too soon!!! They HAVE paid the £3800 worth of charges back , but back into my account, which has just been off-set against the original amount accounted for in my Bankruptcy Order. So in a nut-shell ended up with nothing!!! I did ask for them to send it to me via a cheque as I assumed this particular account had been closed due to the bankruptcy, but obviously NOT!!
Gutted!!!
Please let me know if this has happened to anyone else!!!???0 -
Has anyone claimed following bankruptcy?
I self declared 3 years ago and have been discharged for 2 years. The banks and their charges were THE major factor in my having to take this action. Can I still make a claim for past charges? Allthough they had to write a debt off in my bankruptcy, they had swallowed my wages for many months after applying severe charges to my account and putting me into a spirral of growing financial desperation? (One statement from Abbey National had £850.00 of charges on!)
Please advise.
Cheers,
Paul.😬😬😬😬😬😬😬😬😬0 -
The previous posts should help you but do be aware if you have a debt with the bank you are claiming from any monies reclaimed may go towards that account.0

hi all. I've recently been discharged and have been looking at posts regarding re-claiming my bank charges.
They charged me approx £2500 and when i went Br i owed them £300 therefore if possible theres approx £2200 owing. I've seen a few posts but wonder if any1 has gone through with it and had any success/failures or got any advice? let me know, cheers0 -
