Reclaiming charges, but bankrupt (merged threads)

  • Hi new user, have been reading about being able to claim back charges when the account has been closed and refered to a debt collection agency, but how about bankruptcy? My husband and I are both discharged from bankruptcy now but before that the bank did not help our financial situation with all the charges applied to our account, can we still claim them back even tho the account is closed? and what about credit card charges are they the same?

    You were still charged so can get the money back - ask for your statements from the last 6 years. It doesn't matter the account is closed or you were a bankrupt.
  • Hi there can anyone advise me as to whether I would have a problem with reclaiming bank charges from an account that has been closed down due to having been sequestrated(declared bankrupt) for money owing to other parties other than my bank, the fact is i think i could possibly be owed thousands in reclaimed bank charges and it may off some if not the majority of what i owe and may save me from having to think about selling my family home and being made homeless with two young children
  • Does anyone know if I can still make a claim after I have been declared bankrupt, I have now been released from bankruptcy but don't know If I can still claim for the charges.

  • Hey there, does any1 kno that if you were made bankrupt and have now been discharged, can you still reclaim bank charges even though they shut your account because of goin bankrupt? thank you
  • ellie, my understanding is that if the charges accounts formed part of the bankruptcy, then any money that you gained via bank charges claims would have to go to the creditors at the time you went bankrupt. I hope someone with a bit more experience can come in and clarify this for you.

    Help help help.....my bank charges are from 2001 till 2003 where in the april my wife and i went bankrupt.

    started reclaiming because i felt the charges where a contributing factor to our bankruptcy....

    MBNA decieded they would offer us a goodwill gesture of £230 of a £845.34 claim....but in there kindness they did not give us the £230, they gave it to the creditor who took over when we went bankrupt.

    1st is this legal?

    2nd should they not have given the money to the offical reciever if so?

    3rd if we ignore this and continue to court and we was to win would they have to pay us?

    by the way we was discharged april 2005

  • I am going to shamelessly bump this up the threads because i believe the answer is that if any proceeds relate to the bankruptcy you would owe them to the creditors. BUT please take the advise of others prior to taking my word as i am not 100% certain that this is the case.

  • ive been discharged from my bankruptcy 8 months ago, but i still have 16 months left to £52 towards my bankruptcy. can i claim any of my bank/credit card charges back?
