  • First thread, so hi everyone.

    hope you guys can help me.

    I went bankrupt in November 2006, and at the time I held 2 bank accounts, 1 with Halifax and the other with Lloyds TSB.

    What i would love to know is, can I reclaim the charges from them even though the accounts are closed??

    Yes you can reclaim from closed accounts. The only limit is the six year statute of limitations. So you can go back a maximum of six years.

    I would think that any money that you receive by way of refund will go to the OR.

  • I was declared bankrupt 3 years ago and was released from bankruptcy last year. I went about claiming back my bank charges and recently received a letter from HSBC saying they were willing to refund £990 BUT they would send the cheque straight to my IVA (Insolvency people) and it would be up to them as to how much (if any) money I can get from that. Is there anyway around this? Help would be very much appreciated!

    is it possible to claim back your charges even if i am bankrupt?and if i have lost my old credit card account numbers due to bankrupcy or closed account am i still entitled to phone these companies up and ask for this information

    you can but all money will be sent to the person in charge of your affairs if its over £250.00
  • so it would make sense to make my claim against my bank when my bankrupcy ends then?

  • hi i wonder if anyone can advise me on this. i have been reading these wonderful stories of success and find myself in a situation where i need advice. everything i am reading is saying that friends are reclaiming charges over the last 6 years. my problem is that i was heavily in debt (in excess 24k) but i went into an iva in Nov 2000 which collapsed 4 months later after i lost my job. since the fees cost so much none of my creditors received any money so i arranged with individual creditors payment terms. i now have approx 5K remaining (after paying off 6 of 9 creditors) in debt but wish to know whether i am entitled to claim all the charges i had when i started the IVA in 2000. pleas can someone let me know whether i can claim from 2000. thank you everyone.....anxiously awaiting replies..:confused:

    You can claim back six years from the date your start the claim. Therefore if you start claiming 6.7.07 then go back 6.7.01.

    Ask the OR. The common sense answer would appear to me to be, that if a refund is due to you, having been declared bankrupt, then any monies should be shared out to your creditors. What do you think?
