Reclaiming charges, but bankrupt (merged threads)

  • I have wondered about this myself, but to be honest I have been reluctant to ask questions on this forum as there are some very judgemental comments on this thread....
    my hubby declared himself bankrupt 18 months ago, and was discharged at the end of last year, charges were a very small part of the problem really. Inflexibility on the banks side and hubbys ill health and inability to work were the contributing factors.
    However, we had a joint account which had racked up hundreds of pounds worth of charges, probably paid up about 4 years ago... This account was actually closed by the time we admitted defeat, so therefore has absoutely nothing to do with the bankruptcy.
    Would it be possible to try and claim back those charges do you think? And do you think I should contact the OR regarding this matter?

  • Does anyone happen to know where you stand with reclaiming bank charges if you have been declared bankrupt?? A friend of mine has been advised to make herself bankrupt but was going to try to reclaim her bank charges & is now worried that she won't be able to. Does anyone have experience with this or know anything that may help her??

    Yes but the money they get must go straight to the Official Receiver for the charges up to the date they banked as its not their money any longer.
  • I was discharged in 2005. Since then i have managed to claim back over £500 of bank charges from First Direct. At first they were telling me that the refund would have to be paod back in to my account. I argued the fact that they had a contributory factor in me having to go bankrupt in the first place. They then paid by cheque in full. My OR said he had no interest in the money. This was brilliant.

    Anyway my issue is that i'm now in the process of claiming back some of the credit card charges that incurred over the last 6 years. I've had responses from both Egg and NatWest saying that they would refund the charges into my account. I no longer use these accounts as they were shut when i went bankrupt. As far as i was concerned the debt was written off? Anyway, i sent letters back and forth and they will NOT refund by cheque. They say the money would have to be set against what i owed them once i went bankrupt. My point is that they did have a big factor in me not being able to afford my payments at times down to the knock on affectm from there high charges.

    Egg's most recent letter stated that they will no longer speak to me regarding the matter. My only option is to send the form back with me agreeing to have it paid back into an account that i no longer have!

    Any Suggestions or similar situations?

  • I'm a builder - 4 & 1/2 years ago I was doing a refurbishment which I under- priced. To save face I finished it by borrowing money on credit/charge cards. I was living in rented accommodation and, with no way of paying the money back, I was advised by friends to go bankrupt, which due to certain things happening in my life at the time I didn't do. About two years later, after moving address a few times, some of the creditors caught up with me, and as I was in a more stable situation I was able to pay them back. These payments added up to around £20,000. My question is, can I claim back any of the interest and charges my debts incurred over the years before I paid them back. Some of the balances that I paid were reduced and a settlement figure was agreed.

    I contacted my bank about charges just before the process was put on hold, recieved the letter to say they felt charges were fair blah blah blah!
    I left my bank at that time too before they made me bankrupt.
    Can anyone tell me do I continue to wait for them to contact me?:confused:

    If you wait for them to contact you I think you will be waiting a while.Resend another letter with a copy of your first asking for the refunds.

    almost two years ago my friend had to go bankrupt due to a split with her ex - the ex was unable to get a job, mainly to do with certain habits (eg drugs etc) and she unfortunately picked up the tab.

    During this time, she lost a lot of money due to being overdrawn - this almost certainly added to her condition and overall debt - probably to the tune of hundreds of pounds. Can she claim? She's reluctant to open this case up again - I'm sure she didn't enjoy going bankrupt and she's distancing herself from the event.
