    The previous posts should help you but do be aware if you have a debt with the bank you are claiming from any monies reclaimed may go towards that account.

  • I went Bankrupt in May last year and have now been released from it. I owed Halifax £210 which the majority was in charges I might add. I have worked out they could owe me £1,600 odd. Can I now claim back these charges even though I went bankrupt over £210?

    Please answer me I've posted similar threads and no one has replied as yet!

    I have read and understood most if not all of the small print etc regarding claiming bank charges. As far as I can make out to answer your question quickly, the answer is YES you can claim dispite of your current situation.

    To try and understand, you had charges put on your account (s) regardless if you was bankrupt then or not. The point being, that the charges are beyond resonable cost to the bank. If they indeed only charged say; £2.50 for each charge then they wouldn't be in a situation with all these claims. But they haven't done that. They have charged £30 and more as a charge for their inconvenience. They can't/shouldn't have done that!

    If you follow Martins letters, it will only cost you a maximum of £10 to get all your statements, total up all your charges, make sure you send the second (first) letter with all the information ie. dates of statements, dates of transactions and amount. Don't allow the banks to question or hesitate a reply to your demand!

    Insidently, your question is similar to mine. I questioned the fact that getting bad credit ie closed accounts, default payments etc against your name because of charges, what could be done to reverse this? I also have no answer regarding this.

    Can we still claim these charges even tho we were declared bankrupt in jan 07

    Also will the Nationwide close our account if we claim these charges as we made find it difficult to open another one with our credit history

    I mean I'd be happy with any amount that they offered us as long as it was resonable

    Being bankrupt doesn't remove your right to justice.

    The FSA has warned the banks about doing it, but the closure of the account is still a possibility, so it has to be planned for. Read the article and threads about "parachute accounts"

    I appreciate your circumstances, but don't sell yourself cheap.
    The acquisition of wealth is no longer the driving force in my life. :)

    Yes you can.

    Technically they can't, but that doesn't mean that they won't.

    If you are going to have to fight for your money you may as well fight for all of it as opposed to just some of it.

    Hi

    I'm dealing with this on behalf of my mother. We have received the letter back from the Woolwich with all the charges on it, but since receiving the letter, she has gone bankrupt, some of the money owed was for an overdraft with the woolwich.

    Can we still claim back the charges and if we get the money back does this have to go to the Official receiver?

    Any monies reclaimed will more than likely be paid towards any debt held by the bank.

    Yes you can claim the charges back.

    As for the receiver, well that will depend on your specific case and how you are instructed to make restitution to your creditors.
    Hamsters have no tact and diplomacy, nor do they want any.
