Hi im very new to forums so please accept my apologies if I have done this all wrong. lol.
I was made bankrupt about 4 years ago. I fell into the typical trap of customers not paying on time, with direct debits being paid (incurring bank charges) or I would lose the service of a supplier.I was paying huge bank charges on a monthly basis. In my honest opinion this was a major contributor to my bankruptcy. Can anybody advise me if i can still put forward a claim for my bank charges for the 2 years prior to my bankruptcy?

Firstly thanks for this amazing resource, as soon as I get back to the UK I am going to be chasing up my old accounts. I have looked through the forums and cannot find an answer to my question only to those accounts that have been closed on account of bankruptcy.
My question is this.. I had a student account with overdraft at the Royal Bank of Scotland (based in Edinburgh). I unfortunately ran into debt and charges for going over my overdraft built up and eventually the account was closed (in 2005). It was then passed on to a collection agency and listed as default.
I have paid off the amount in full, but I was wondering if I could claim back the charges that would have put it into default in the first place. However I understand I won't be able to claim any additional charges that have been amassed through the collection agency..
Are banks required by law to keep records for accounts that they have closed and is there any precedent for claims regarding defaulted accounts?

If you have been made bankrupt and still owe money to the bank, is it right that any effort to claim bank charges would mean it would go straight to the Bank rather than the person claiming?
Could any of this money go towards discharging some of the money owed from the bankruptcy proceedings or would it not count at all?
Just a question on someone else's behalf, any advice appreciated.0 -
More than likely the money will go into accounts that are in debt but I'll merge your post into a thread regarding this.0

A really good friend of mine lost her job about 2 years ago, soon after losing her job she fell pregnant. Due to the fact she could not work her debts spiralled out of control.
In the end she was forced to go bankrupt.
Can she still reclaim her bank charges ? I know she could do with the money and I am sure she must have loads of charges against her account. I would really like to help her out.
any advice would be a great help.

I have the forms to file for bankruptcy and am halfway through claming my bank charges.
is it best to wait to get my claim money before filing for bankruptcy or doesnt it really matter?0 -

I'll pop your posts into a relevant thread but you need to be aware that any monies reclaimed are very likely to be paid towards any debt held by the bank.0
