Reclaiming charges, but bankrupt (merged threads)

  • As I declared mysefl bankrupt in 2005 and got dishcharged in 2006 how do i stansd baout reclaiming charges on the accounts i went bankrupt on?

    Also what happens about closed accounts (that i had paid off before I went bankrupt) that i no longer have the account numbers of - can teh bank refuse if i dont know the number?

    Send the bank your name, any relevant addresses and your date of birth along with the template letter asking for your info/statements and they should be able to trace any old accounts.

    As for the accounts when you went bankrupt, there doesn't seem to be any actual stories as to what has happened.

    Can I still apply to reclaim bank charges even after being declared bankcrupt 2 years ago? I know my old banks used to charge me left,right and centre with bank charges and this all contributed to me having to file for bankruptcy in Nov 2004.Any info appreciated. Thank you.
  • :confused: I've been bankrupt for 3 year's now , and i was wondering can i claim the bank charge's back from the bank's that helped me go bankcrupt in the first place ?

    you can but any charges incurred prior to the bankruptcy the refund would have to go back to the estate to be distributed by the court - even after you are discharged.

  • My bank must have charged me thousands before I finally couldn't take any more and had to declare myself bankrupt. My account with them was closed with me owing about £14000 from a loan and overdraft. I took out the loan on their advice after repeatedly going overdrawn and not having the ability to pay get out of the hole and be able to pay rent etc without taking the loan. I admit a big part of my bankruptcy was down to me not managing my finances well enough but I attribute much of that due to hundreds of pounds in charges I was getting each month.

    Would I still be able to claim these charges back with this scenario? I was discharged from my bankruptcy last year and I am now getting things back on track. I'm assuming I wouldn't be able to reclaim them and they would be offset against the amount I owed anyway. I'm asking only because people keep on telling me that I should do this.
  • Hi everyone, im very new here and this website is a total eye opener.

    I too like the rest of you want to claim back unfair charges that have been put on me over the last few years but I have some questions that I wonder if someone could maybe answer for me.

    I have 2 old bank accounts (but I only have the A/C details of one of them) Can I use the data protection act letter to get my old statements just using my name and address only?

    I also would like to claim back charges on 3 old credit cards but again same as above I dont have the A/C details other than my name & address.

    Last but not least I went bankrupt last year as my debts got totaly outta control (charges is what I was paying most months and hardly bit into the debt of the loans,cards etc..)

    Can I claim back all these charges even though I am bankrupt? Any money that I get back will most likely go to to insolvency people anway! (I have no problem with that as even though I went bankrupt I still have to pay back £7k and any money I can get will help pay off this debt to my creditors)

    Any thoughts or suggestions would be greatly appreciated as I would like to turn the tables on the banks for a change and get some payback.

  • I declared myself bankrupt in 2006.
    Is it possible to reclaim charges for any of the accounts held at the time?

    Also I had bank accounts with Barclays & First Direct, which I decided to close due to outrageous bank charges five years ago, before any signs of bankruptcy. Can I reclaim charges from them?
  • hi, just wondering if i could try to reclaim the many bank charges i incurred before becoming bankrupt. The account is now closed, as it and the debt that was owed on my overdraft was listed in my bankruptcy order.
