A friend of mine has asked for some help and this is probably the best place to find it. A few years ago she was made bankrupt, and as part of the process defaulted on a loan. Her bankruptcy has now been discharged. If she claims the bank charges, can the bank in question retrospectively apply any refund to the defaulted amount ?0

the one i am stuck on is if charges are owed from a bank that he sorted his debt with before he went bankrupt, if these charges are recovered do these monies go to the official receiver or do they go to him.
one other thing if he went bankrupt but his wife didn't can she recover charges from a joint account that was sorted before bankruptcy so there is no financial hold from the receiver.

I am not paying the £10 each time on the basis that there maybe no charges. i will only pay if the request it.

Hi, this is the first time im using this forum, sorry if this question has already been asked, but just over a year ago I was discharged as a bankrupt, does anyone know if I will still be able to claim back my bank charges as it was due to them that I had to go through bankruptcy and I have paid the charges before, I need to claim back from Halifax and Natwest, Thanks

Ive got my cheque and letter ready and would apreciate it if somebody could help me??? I spoke to Natwest today and they said refunds are based on individual circumstances is this true???

Well I dont know if it will make a difference, but I am a discharged bankrupt most of the debts I had were due to charges and fines, some of the cards that I will be claiming from were not included in the bankruptcy so I dont owe them any money, but due to bankruptcy rules all accounts get closed minus or not!...annoying
I also spoke to Citizen Advice bureau and they said I should still be able to claim.
I dont have any ties with the O F anymore so that should not cause any problems...
so hopefully I can still claim????? well I posted out my two letters today to Halifax and Natwest to request my statements back, lets see what happens!!!

When I went through bankruptcy I was made to sign papers stating that If I came into any money it would have to declared and that the official reciever would have total control over all finances, so even if you do get any charges back now the official reciever (OF) will find out and can demand it all to pay your creditors or off your debt, if you dont tell them trust me they find out, but its worth speaking to Citizen Advice or the OF,

I was made bankrupt in November 2005 :eek: and discharged in November 2006 :j
Now I am discharged does anybody know if it is possible to reclaim my bank charges? Bear in mind of course that I did owe some of them rather a lot of money (not through overdrafts but through bank loans and credit cards)

Hi i have just found out about this site today! I am 26 years old and have been made Bankrupt in December 06...:( I thought this was my only option.. advised by the CCCS etc.
In breif i would just like to know where i stand on the bank charges recliam business? I must be have piad 1000's over the 6 years they can look at!
Also i was given a lloyds TSB graduate account when i was not even a graduate with a £1700 overdraft and then given a £10,000 loan all from this account!
Looking back i believe this was where i went wrong!
If you have any information please help me, i feel that this situation could have been avoided a long time ago!

How much have you paid in bank charges? My advice would be to read the articles on how to reclaim those first.also known as The Sausage King0
