Reclaiming charges, but bankrupt (merged threads)

  • As the title says, is this possible or will I be wasting my time as I was declared bankrupt, or will I be able to claim the charges back as they added to the problem?
  • Hi - I dont see why not!! I`ve just completed an IVA (very short one) and I`m going for all the creditors of adding to these debts in the first place!
    At least it gives us a little bit of justification after all the stress we`ve had to suffer on their behalf!

    after my success of reclaiming my charges i have been telling everybody i can to reclaim their charges and a friend of mine posed this question......Can you reclaim charges if you have gone bankrupt?

    the situation:

    my friend spent far too long living beyond his means like a lot of us do. however his situation got out of hand after being made redundant the banks started hitting him with charges.... the usual suspects returned DD, exceeding OD and charges for honoring cheques guaranteed with a switch card.

    He sorted himself out, got another job, got his finances back on track and started living within his means then a couple of kids later and another period out of work he found himself in the same situation with ever increasing charges and debts.

    He tried to get it under control with a IVA but it all got too much and finally had to go bankrupt.

    i can only imagine that the banks that he went bankrupt with are unlikely to give him any money back as he owed them money when he went bankrupt, even though they were a contributing factor in his demise, but what would his chances be of getting any money back from anybody who charged him extortionate charges over the past six years.

    MBNA cc's requested charges
    Sainsburys cc requested charges
    Sony cc requested charges

    I am not paying the £10 each time on the basis that there maybe no charges. i will only pay if the request it.

    Capital one cc requested charges
    Alliance and Leicester requested charges

    Capital one claimed £440+interest he accepted £150 goodwill
  • I'm probably being cheeky in asking, but would it be possible to reclaim bank charges incurred before I went into a protected trust deed? I've now finished paying back my trustee. Does anyone know?

    Hi,
    I went bankrupt in Sept 2005, can I claim back any charges made prior to that date on credit cards that were included in my bankruptcy?

    I'm considering making a claim for charges against a number of banks for charges up to an including Feb2005 when I was made bankrupt.

    Since Feb 05 I haven't incurred any charges with my current bank.

    My question is; Can I claim my pre-Feb05 charges from the banks I had accounts with a) even though I no longer have accounts with them, and b) even though I went bankrupt, and some of them lost money in my bankruptcy?

    Any advice greatly appreciated.

    I was delared bankrupt (debt of 17,500) in august 2005 and was discharged in april 2006. I was just wondering whether I would be still able to reclaim bank charges from before I went bankrupt and whether the charges would be claimed in the bankruptcy? I would be interested to know the legal ins and outs of this situation. Also it could be said that the unlawful bank charges contributed to my need to declare myself bankrupt in the first place due to the compount interest etc...

    I would be interested to hear if anyone has any thoughts on this.

    just to clarify if i understand the posts in this thread correctly.

    1.if the bankruptcy has been discharged my friend can reclaim the charges and keep them for himself.

    2.if the bankruptcy is still live the official receivers can recover any outstanding money's owed to the organisation he is claiming from.

    the one i am stuck on is if charges are owed from a bank that he sorted his debt with before he went bankrupt, if these charges are recovered do these monies go to the official receiver or do they go to him.

    one other thing if he went bankrupt but his wife didn't can she recover charges from a joint account that was sorted before bankruptcy so there is no financial hold from the receiver.

    Hello i have about £2000 worth of bank charges, can this be reclaimed if bankrupt and the bank acount in question is closed?:o
