I dont owe any money to the bank(my personal account}but do have a credit card...hmmm i just dont know if it would be best to wait until after ive got my charges back before filing for bankruptcy...?0 -
Well I’m not bankrupt but I am in debt for like forever - had 2 loans, and 3 credit cards etc, never missed payments etc and thought I would eventually pay them off in a few years but then I got ill and found I couldn't quite cope anymore. Once it was all totted up with the interest it all amounted to £50K - couldn't believe it.
Thought about bankruptcy but in the end went down the Payplan route.
I banked with Natwest at the time. I'm now with Lloyds.
I owe Natwest £1700 for my overdraft and about £9000 for a loan, which will probably get paid off when I'm like 80 as its a tiny pro rata payment.
I got totally stiched up with bank charges from Natwest despite them knowing the score with Payplan - they charged me £40 every month for a long period and there was even a month where I received 6 x £40 charges!
Am I entitled to reclaim bank charges against Natwest despite owing them money?
Has anyone tried this or aware of the implications?
Would they then ask for the money back? Or would it disgruntle my other debtors and nullify the agreements I have with them?

i think it depends on how long you ve bankrupt?

its been on here before that legally there is no reason why you cant becasue the charges were unlawful. I think that for people who are still bankrupt (undischarged) if they won the money then it would have to go to the official reciever nad even after being discharged it can go 'into the estate' which i assume means if you owned a house and it is still in the process of being sold the money you get would go into that but otherwise as you are discharged and if you do not own a property then there is no reason why you cant claim back the charges and keep the money. I also went bankrupt last year and have been discharged and am in the process of claiming back the charges. They've got till 10th May to provide me with details of the charges. Some people think its immoral to go bankrupt owing the bank money then ask for some back but its not illegal.Claiming back from Natwest: £595+intrest

Since Jan. 07 I have been trying to re-claim my bank charges from the TSB but I have one small problem!!!
I have been discharged from Bankrupcty since May 2006 and the bank as agreed to pay me out in full £317 as a 'full and final settlement'. But there saying they will offsett this amount to reduce the money which was part of the Bankrucpty Order and send me any left over (which would be none)
Are the Banks allowed to do this?
Or should I write and state I disagree to this and enter it into Court?

My friend went bankrupt in 2006 and would like to claim back her bank charges. She is unsure if she can do so because of her bankrupcy and we were wondering if any1 can confirm whether she is still able to.
I would presume that she can as the charges are unlawful but would appreciate it if sm1 could confirm this for us.
