  • Hello - Firstly thank you so much for this.
    Mine is a long term question as you'll see. I'm late 40s, my partner early 60s. I receive DLA, IB, and my mortgage which is an interest only mortgage is paid. My question is what happens when the we reach the end of the mortgage - when I am 60, and partner is late 70s I'm pressuming the Bank can just throw us out? I know its a while to go, but it does play on my mind. The house is currently worth around c120k and the mortgage outstanding is 70k. Once again many thanks...
  • Thanks for advice, forgive me but does this mean a couple, one who works, one who is very ill also SMI and two adult children (who work but for now still at home)cannot get reduction even though full DLA for the ill person in any circumstances?
    What a complex area. Thanks again - really appreciate advice.

    Thats correct - council tax is based on 2 adults in the property - as long as that condition is fulfilled and those 2 adults aren't disregarded, Council Tax is payable in full.

    In your case, their are 3 adults who aren't disregarded, so even if 1 of those got disregarded, their would still be 2 adults and Council Tax would be due in full.
    I no longer work in Council Tax Recovery but instead work as a specialist Council Tax paralegal assisting landlords and Council Tax payers with council tax disputes and valuation tribunals. My views are my own reading of the law and you should always check with the local authority in question.

    hi, i am a housewife married with 4 children, i receive high rate, long term incapacity benefit and have been for a while.

    i got a letter from hm revenue and customs asking for details of my incapacity and attendance allowance !!

    i phoned them and told them i only get incapacity benefit, it now seems that since 2005 tax credits have had me down as disability living allowance and attendance allowance !!
    i did tell them when i went on ib that they had got it wrong they said that ib comes under dla i havve just phoned tc helpline and they are saying its all my fault i explained i had told then on many occasions they had it wrong ang i was told that it ok....

    glasgow hm revenue say they only thing that will be different is the disability allowances they give as dla is a higher allowance than ib allowance??
    can anybody help !!
    i have a blue badge so am i classed as disabled??

    what sort of amount do you think i might have to pay back#?
    will they take it in one payment, i hope not i cant afford it, it was there mistake, should i send a complaint letter in to them !!
  • Hi there and many thanks to all of you who have offered your advice & help.

    Need some advice for a friend please. She has one child (just over a year old) and her husband has recently come over from abroad. They are living with family, and he has started work this week in a temporary job paying minumum wage @ 40 hours per week. She had put in a claim for income support as a lone parent before her husband came over and this was just awarded to her, witha back payment. She called IS to let them know her husband is here and they have said that as she is not a lone parent she has to pay back the money (about £600). Is this right? She was a lone parent when the claim was made and did not know if or when her husband would be coming over. She is really panicking as she has spent most of the money paying back people she had borrowed off while waiting for the claim to come through.

    Any help/advice would be appreciated. Many thanks

    Unless you have applied for Disability Living Allowance you can't be receiving it. If they have you down as receiving it they have made a mistake. Attendance Allowance is applied for if you are over 65 and you can't be on DLA and AA at the same time (you can claim DLA up to the age of 65).

    I suggest you get advice from your Citizens Advice Bureau as they can also phone on your behalf and find out exactly what's going on.

    She will still be entitled to Income Support for the period that she was a lone parent. She should go to her local Jobcentre where she needs to sign a letter (or form if they have a special one) stating exactly the date he moved in. She should put in a claim for Working Tax Credits and Child Tax Credits for the family if she hasn't already.

  • My boyfriend and I are moving in together this year (we'll be getting married next year) and he has shared custody of his three year old boy from a previous marriage. He will be staying with us 3 nights a week. Will we be entitled to working tax credits or child tax credits or anything else? I'm thinking that we probably don't because we only have him three nights a week. Plus we wouldn't want to claim if it meant that it would reduce his ex-wife's entitlement. Any advice?
