  • In your dreams. No lawyer would write or agree to the signing of this wording. Your time and energy would be much better spent looking for a new job. Preferably not in HR.

a lawyer has already agreed to it.

    right.

    and?

Any need to be so rude when people are trying to help you?

The 'and' is that if it is simply a corroboration of the previous CA and not a new CA then it gives you no more protection in law than you had yesterday. It doesn't change the situation.

' <-- See that? It's called an apostrophe. It does not mean "hey, look out, here comes an S".

sorry didnt mean to be rude, its just that if you read through the thread some people thought that the employer may have had a get out clause because the agreement wasnt worded tightly enough in its original terms.

    I'm sorry, I don't believe you.

I should clarify. A lawyer would never agree to a company signing a document which gave retrospective clarification to an issue which, subsequent to the existing agreement, was POTENTIALLY breached. Why would they?!! They might as well just give you the office safe keys and be done with it! They will also not produce a signed document which effectively stipulates they must lie. So I'm sorry, I do not believe this wording would appear in a document which ends up getting signed, whatever the email you've had suggests.

I suppose it is possible that the OP is sleeping with this lawyer. Cannot see any other reason they would agree to it.

as a matter of fact 'deny any knowledge' is not quite the same as lying.

It is lying if it is documented that they do have knowledge of the matter. Which appears to be the case.

It won't be produced, unless you are sleeping with or blackmailing the person who is to produce it!! It wouldn't stand up in court even if it DID exist (which it won't). A judge would not look kindly on a document which effectively insisted that a company lie! And I repeat, a company would NOT give you a signed document which could in any way be interpreted to say that they breached a previous agreement. I ask again - why would they?!
