Fined for parking in disabled bay, but AM disabled.

    I've written to IKEA about it and asked kindly, but firmly, that they speak with ParkingEye. Will see what comes of it.

    My very sincere apologies for those hoping to request off-board assistance but I am now so inundated with requests that in order to do justice to those "already in the system" I am no longer accepting PM's and am unlikely to do so for the foreseeable future (August 2016). :(

    Dunno if anyone else, but maybe we could get a fund rolling for it? I'd love to see it, just to slap Disabled Parking UK, who don't forget are having passionate intercourse with a private parking company in exchange for money, repeatedly over the face with the cheque in compensation.

    I've given them a deadline to respond by, so can't do anything about it until then. Which is a little annoying. But, as I stated previously, I hope they fail to reply, or fail to reply the way I want them to... in which case I'll happily take them to court.

    I wrote to Asda now just over three weeks ago and I still have not even had an acknowledgement. I spoke to the local store 10 days or so ago to be told that the matter has been referred to head office. We'll see what flows from that. ;)
  • Quick update.

    ParkingEye turned down my appeal (sent before finding this wonderful forum, of course). They stated that should I wish to send further evidence, they would look at the case again. Not replied to them, but feel if I am to go to court with IKEA/ParkingEye over this, I need to be seen as doing everything I can to rectify the issue.

    Also... IKEA called me today. As most of you know, I sent letters to three different addresses for IKEA. Their solution is to have me PAY the "charge" and them reimburse me. Not willing to do this, as what are the parking company learning from it? That they will get their money one way or the other? That they can continue to treat disabled people like second class citizens?

    No chance. I refuse to pay, but have a sneaky suspicion that IKEA will pay this charge and I will simply receive a receipt from the parking company.

    IKEA (or at least the woman from IKEA) informed me, "we have nothing to do with the car park, it is a separate company, they (parking eye) deal with car park issues and I could have simply wrote to you saying deal with it yourself. But I wanted to help you as you're a customer."

    I know the easiest solution would have been to pay it and have IKEA give me the money back, but I am genuinely appalled that this is their way of avoiding what could be an expensive trip to court. Basically a "We'll pay the fine so you don't have to."

    Thoughts anyone?

    Somebody must have asked Parking Eye to patrol the car-park. If it's not IKEA then it must be a third-party landlord/landowner. If it was IKEA then they can't get out of it by saying "nothing to do with me guv".Parking Eye are acting on their behalf.

    Hey. I agree completely. If she calls or emails again, I will ask her to confirm who owns the land. Thing is, if she doesn't give me an answer I'll find out when it goes to court (which is currently where it's heading).

    My thoughts are to ring her back and ask her to put it in writing that IKEA's view is that that compliance with the Equality Act in their car park is not their remit, only a matter for their agent the parking company! You just want her to confirm what she said really, in writing 'either pay up and we will refund or deal with it yourself!'

    You could claim compensation if you've informed both companies of your disability and they are both washing their hands of it.

    Ask the lady to also tell you what will happen in the future if any genuine disabled person - including you - wants to use those bays but has no Blue Badge to display, or needs more time to shop than the maximum limit.

    And the parking company IS their agent as IKEA have allowed them the contract to act there (even if no money changes hands). My understanding - although I have no legal training - is that IKEA are the primary agent here.

    Totally agree with your stand! Of course no disabled person should be subject to harassment with a bogus and unlawful PCN, then have to pay the scammers and plead their case for a refund from IKEA - for daring to park in a bay that is provided FOR ALL DISABLED SERVICE-USERS under the reasonable adjustment provision of the Equality Act.
    PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

  • I called Giltbrook Retail Park today and asked simply, "Who owns the land?" - "British Land."

    Call British Land and get a machine. Email British Land. Thirty minute later I receive a call from Savills (the actual land owner). IKEA had contacted them over the issue and he was calling to sort out the charge. Great, but I have to send a copy of my blue badge. So, again, as long as I have/had a blue badge, all is fine. But what if I didn't? going around in circles because none of them seem to know the law.

    Getting a headache! Will copy and send blue badge tonight, but we as a group need to do something to stop this happening in the future. No one else will :-(

    Ideas anyone?
