Fined for parking in disabled bay, but AM disabled.

    No I do not need a blue badge nor have one.
    My point is you got a space, if you got there and they were all taken, often by people who dont need them, you would have had to drive home.
    What would your solution to that be? Perhaps the reason IKEA have free disabled spaces is becuase they inforce them and people know to avoid abusing them?

    I agree on both counts.

    But people do not have to get a Blue Badge if they do not need it, why should they? And not all disabled people might be able to get a Blue Badge but would still be eligible to park and use a reasonable adjustment such as an advisory disabled bay in a private car park.

    We are on the side of disabled people on this board, we have posted before on the subject on other threads. The solution in many cases where disabled bays are full is that the retailer needs to provide more, not 'police' them more.

    Disabled BADGE abuse is rife. Disabled BAY abuse on private land, happens sometimes as we all all know, but is nothing like the problem the PPCs make it out to be. Show me the proof that says otherwise, there is none and the truth is that most people do not use disabled bays unless they have the disability need.

    No survey has been done that actually seeks to find out whether someone is eligible to park in a private disabled bay. There was a vigilante-style 'Baywatch scheme' where the so-called charity Mobilise encouraged people to report perceived 'bay abuse' to them. But the two big problems with that were that people were reporting anyone without a Blue Badge (pointless) and of course, Mobilise are in the pocket of a couple of Private Parking companies.

    My solution would have been to wait for a disabled bay to become free. I COULD NOT park in a standard bay, there was simply not enough room. You are a very annoying person. You seem to have it in your head that you are correct and refuse to listen to any other opinion (or law for that matter).

    I don't make a habit of calling people, and I detest the fact that you have bought me to this level.

    I stand by my decision to park in the bay as I feel I had a right to do so. And just for your information, IKEA don't police the bays, ParkingEye do (badly!). The reason I mentioned reporting the issue to IKEA is that the land belongs to them, so inevitably, they are the ones who are subject to any action arising from this.

    Im not saying the blue badge is full proof but its the only mechinism to determine.

    The situtaion of not displaying a blue badge is no different than not displaying a parking ticket!

    I actually appluad the company issuing fines for people using the spaces with out a blue badge!

    You are in the right, xoxnitaxox and the law says you could park there unharassed. Someone needs to sue on this point, 4-figure compensation and some useful publicity against parasite PPCs awaits the first person to do so.

    Totally agree. Disabled Bay abuse is not the problem PPC World pretend it is (but they would say that, wouldn't they?).

  • I find myself almost wanting to receive another demand from them simply to be able to sue to prove my point.

    They have 14 days to reply anyway, so can't do a thing until then.

    The PPC indulge in disabled bay enforcement because its easy for them to issue their charges. A person can park in a disabled bay and display a blue badge. The PPC's conditions have been met! However the blue badge may not belong to the person who parked. So their enforcement is a nonsense!

    The PPC can not insist on seeing the blue badge, so how are they "stopping disabled bay abuse" their not and their not interested in doing so.

    A parent with a severely disabled child under two can not get a blue badge! Where do they park? If a disabled person requires the disabled toilet in the store do they have to prove/show they are disabled?

    Unfortunately we are going to see people abuse all parking situations but I would rather see the chavs getting away with parking in disabled bays then see one disabled person being penalised for parking in one!

    Facts:
    • I am disabled within the meaning of the Equality Act 2010
    • I can only walk relatively short distances and often make use of instore wheelchairs once I am inside a supermarket
    • I do not have a blue badge
    • I am otherwise fit - my disability is not lifestyle linked but due to a stroke I suffered at a young age.
    Consequences:

    As a result I can no longer legitimately use disabled spaces at my local Asda who now use T & C to police them. I still eagerly await a ticket :D and an explanation from Asda setting out the reasonable adjustments they intend to make in order not to substantially disadvantage me. Its taken them 3 weeks so far. :)

    I do use disabled spaces but only late in the evening and when there are plenty to be had but besides being inconvenient this prevents my being able to enjoy a wider stock selection and fresher goods.

    For the record I am not a parasite. I receive no benefits; I run my own business in which I work full time; I own my own home and drive my own car (not a Mobility one - not that there is anything wrong with that) and only want to be cut some slack so that I can shop like everyone else does. I am being prevented from doing so by the arbitrary necessity to belong to a particular club concocted to enable a company to make profit. That has the smack of fascism about it and rather than call me a parasite the companies profiting off my back and those of other non-blue badge holding disabled in this way deserve the title far more don't you think?
