    You could always buy it from them :) especially as they have now re-continued the discontinued model :)

    Wouldn't that be ironic...going to court with your receipt for the TV purchase and it being from Ebuyer :)

    Godd luck shrek101, but I still think you will need to have purchased the set somewhere before you can claim 'loss of bargain'. If you really want the set, then I'd say you are going the right way about it, once you have actually bought the set elesewhere.

    You don't have to get the same set some companies sell items specific to that company, you have a better case to get a comparable TV, however it isn't always a case that you have too.

    I have now got a letter drafted and will be sent later today giving them 10 days notice. Or I may go to the Small Claims Court.

    Before any starts, I truly believe a contract was entered into, I accept that there is a strong argument that it was a mistake, one could argue many of us are greedy. I could argue that they are greedy by getting funds without adequate checks in place. They subsequently lied when they said that they have discontinuing the TV, yet its still for sale. They breached there own terms and conditions 1.3 and 2.3.

    I need a new TV, my motives were that it was a bargain, and that I went for a good deal that was too good to miss.

    Great! No problems with that. But I still think you have a better case if you can get an identical set (e.g. from ebuyer!!!???, or better still, from Tesco where it costs more).

    I havent been able to source the exact same tv accept Ebuyer. The model is Samsung WS28A116DSX. Ironic then that you would have to purchase it at Ebuyer or a comparable model else where with has tv cabinet, 100hz and freeview builtin.

  • Just had a major panic, checked my c.c statement,as you do, and noticed another 39.46 taken out by ebuyer. Down to earth time, the statement on line had got all the transactions out of sequence. Never mind.
    Down south where, unfortunately, the government does remember us.

    Whoever told you that rubbish is misleading you big time - I employed the services of a top consumer law solicitor in my fight with Sky Buy and the Judge at the preliminary hearing laid it down clear that he would only consider awarding for loss of bargain if i bought the exact same item - no ifs no buts...only when the brief bought up the subject of shops own brand goods did he concede that you could buy comparable goods but it owuld have to be another shops own brand not a general marque....

    Fact is I am pursuing this regardless of what Ebuyer or what others say.

    Loss Of Bargain

    you really are an obnoxious person do you know that? do you not read anyones postings properly - I see you seem to have an argument with just about everyone who doesnt agree 100 per cent with YOUR opinion.

    What I was told was not rubbish if you actually bother to read my experience and it was an experience - i have been there done it got the award, mine has been to court already, I have been awarded my loss already - not hearsay not ifs and buts and waht ifs but done and dusted - an award in excess of £3500. I give up with this thread - the people on here have been given the advice they need to have a successful claim and yet they still whinge on about how poor ebuyer are and how they deserve this and have you seen how they have ripped people off. If you are going to do it then get on with it I would wish you luck but i have taken an instant dislike to you
