    Great, izzy_flint, but don't understand what you mean by:

    I now clarify if you broke the contract or where indeed where the law defines when a contract is legally binding.

    Can you enlighten me please?

    Regrding agreeing to the Terms and Conditions. By registering with them it looks like agree with them....look at the sign up page.

    I placed an order for two of these tvs (one for me and one for mum).

    Anyway how to i go about making a claim online with the small claims court and how much will this cost.

    I understand that i still probably wont get the tv at the lower price however if this procedure cost say less than £100 im def willing to go ahead with it even if its just to make a point/inconvenience the company.

    Sorry if this has been said before - can't be bothered to read all the replies here but if it states that funds need to be "cleared" for the contract to be binding then has anyone checked how long their particular bank etc allows for "cleared funds"....it might come out of your account straight away - doesn't clear to their account same second.....might be wrong but always seems to take at least 48 hours for funds to clear into someone elses account.

    A bit ironic but just found this on a gov. site consumer direct.


    However, a trader who mistakenly prices a product (for example, “28 inch widescreen television for £39.90” instead of £399) is not obliged to honour that price unless the transaction has already been completed. The trader must nevertheless take immediate steps to rectify the mistake.


    Plus everyone reply to their email with their own terms

    1.2 No contract exists between you and the Supplier for the sale of any goods until the Supplier has received and accepted your order and the Supplier has received payment in full (in cleared funds). Once the Supplier does so, there is a binding legal contract between us.

    I think this is academic as any refund will also be confirmation of receipt of payment why would they want to refund uncleared payments?

    i don't think they could wriggle out of it on semantics - credit cards don't really 'clear' but the amount is 'ringfenced' and there for them to take as long as they don't cancel the credit card transaction.

    The payment is taken electonically. If it had not cleared, they would not have proceeded the order to 'Picking' and my online bank account would not be showing the difference between my balance and available funds to the tune of the amount being paid.
    Even though it doesn't show as a transaction yet, monday morning it will.
