so who's going to start a claim online first then? hehe
i like this bit: "The defendant has 14 days from the date of service of the claim to respond. The date of service is calculated to be 5 days from the date the claim is issued." So really 19 days to respond - that's about the norm for them!! If you get no response "you can request judgment by default. This may result in an order saying that the defendant must pay the money claimed on terms specified by you."0 -
The small claims court is fine to claim back money you think you are owed, however i would think that most of us would prefer to have their order honoured. They are going to refund our money, so we have only been inconvienced and dissapointed, how can we claim for that?
Watchdog and trading standards is the way to go IMO.0 -
Ive emailed them as well quoting the terms and conditions previously mentioned. I can not see me getting any way but you have to try0

Money Claim Online can be used by:- Individuals
- Solicitors
- Government Departments
- Businesses
- Claim (fixed amount of money)
- Judgment
- Warrant
So it would be for a judgement for the claimant. Either that or a money claim for damages as a result of their breach of contract (ie the difference between what they would have charged and the cost elsewhere).0 -

Brilliant article, I have never had a problem with ebuyer (spent about £1000 over 3 years) until my last order, quickly; Had a faulty mouse from them, sent back asked for replacement, instead they refunded meaning I lost out on P&P costs both ways! I really did want the mouse and tackled them about the replacement, they said I had said refund, when it clearly says on my 'orders' page 'replacement'! They then proceeded to CHANGE my account page to say I requested a 'refund', the cheek of it, e-notes did no good whatsoever(even though I have a screen grab), they eventually ignored me and so I ignored them for a month.
Problem is though I can find no-one to beat their prices and so I continue to use them, indeed I bought the 28" Philips widescreen, mentioned on this site the other day, just have to wait till Friday for that.

I thought I had better get my 2 penneth in and sent them an e-note. Don't expect much luck but gotta try. They would not have let me cancel the order once money had been taken so why should they be able to.Down south where, unfortunately, the government does remember us.0
