It's not a simple accident but a series of related accidents, there were other people who died and also two with serious injuries, and it is probable that there were other factors involved beyond driver error. I expect you'll understand why I can't be more specific on a public forum, and also why it's taking a long time for everything to be investigated to a point where all parties are ready for the inquest.

Yes, I understand. I was involved (making calculations of loss) in a case where someone was killed by a motorist driving the wrong way up the motorway. It was not simple, that's for sure, and the compensation claim was still dragging on nearly 10 years after the accident. It was a very sad matter all round. Eventually, the claim was settled, and the family had closure at least on that.

You ought to check with your PI solicitor whether it's okay to use the insurance money to pay off the estate's debts. I say that without knowing who was liable for the accident. It may be fine, but you don't want to get into the position where as executor you may possibly have to make good the money that you now pay out in good faith.
No reliance should be placed on the above! Absolutely none, do you hear?

Thanks for your concern. I'm sure she's fine with it. The whole reason she suggested sending the PM report to the probate sol was because I was having a bit of a moan when I met her and mentioned that we wouldn't be able to pay off the CCs until we got the full death cert. She said, "oh but they usually accept the PM report" and we took the conversation from there.

The situation may be very complicated, but it is very clear that late-nearly-ex was not at fault, and nobody involved has at any time suggested otherwise. Briefly, he was in the correct lane, travelling within the speed limit, in control of his vehicle. Not all the other drivers were, although that may be at least partly because of factors that were not their fault. Hence the investigations. In any case, if the policy says it pays a death benefit into the estate, I think it's OK for the estate to use it, even if there might be further claims on the insurance later, which there won't be. ;)

On a different note, I was so encouraged this afternoon when taking DD for a walk in the park. There was a group of lads there - in some respects they had a lot in common with the rioters: same sort of age, same all male group, same loads of physical energy, same raucous egging each other on to take risks - but all harmlessly directed towards the skate ramps with a few bicycles and some roller blades. One of them was over by the path when we went past and politely made way for DD to struggle up the hill on her own roller boots before zooming back across to join his friends.

Tyre performance in the wet deteriorates rapidly below about 3mm tread - change yours when they get dangerous, not just when they are nearly illegal (1.6mm).
Oh, and wear your seatbelt. My kids are only alive because they were wearing theirs when somebody else was driving in wet weather with worn tyres.

lir: has OH managed to get a lock etc sorted? Will he be safe tonight?

He put a lock from the shed on the front door. There are also bolts on the insdie of the door, so can be secured well from within, better than when out! He's not staying there tonight, but rather in the new place....I think. Not sure though, yet! In fact I think I'll call him right now. :)

I think they have metal couplings between the plastic sections. Also, how do you know they haven't thought about this and incorporated a bit of metal in the plastic pipes? Or even, heavens forbid, they are making accurate records now?

Because they couldn't locate the new bit of pipe that was used to joint the old pipework to the new meter position, so had to dig up the drive to find it.

Also, they dug many more squares out of the pavement than there are connections, just because the metal detectors find disused pipework underground with no idea which is live, which is disused and where any modern plastic piping may be. And they are not noting down where the new stiff is going according to the bloke I spoke to.

Driving to folks today, with eldest for company.

Interesting to see how journey time compares and petrol vs. train fare.

156 miles in 2hours 35 minutes drive time plus one stop for 40 minutes.

vs 4 hours minimum door to door on the train/ tube/ bus/ walk at either end.

I used half a tank of petrol roughly. So total petrol cost for return trip would be about £46 plus £5.70 toll bridge vs. £70 for super off peak return. Cheapest train fare would be £36 if booked well in advance and for specific trains, but that would mean knowing exact timings and a longer journey time to allow for avoiding missing specific booked train.

All police leave cancelled according to the news. So what happens if a policeman is on holiday overseas? Do they have to get the first flight back? Just wondered.

  • No - it means days off, or court days, or training, not holidays.

No sign of LJ since the brimingham stuff???

Anyay, here I am worrying about you lot and I had an intruder tonight. Very odd.....loud music in a car that then left then all I could see was the end of a lit cigarette...dogs were going crazy (''fresh meat'' they barked, ''yes'' I hissed at them ''and it could be armed'' - been watching too many riots?) Called the police gave them good directions, but couldn't remember the grid reference.....watched them sale past where person was smoking, with lights on. Then cigarette disappeared and dogs shut up.....

took them 15 mins to find there way back (they'd gone to another address) then they explored the barns while I shot off to check field gates (can't see horses but the chains are all on the gates).

Heart is pumping now. Its horrid, but not so scary on previous occasions.....overactive imagination tonight. It was probably a couple had a tiff and one turfed the other out at a convienent looking spot.

Oh lir, that sounds most unsettling for you. Glad it all seems to be OK now, and also glad you've got the dogs. Can I suggest you write the grid reference on stickers and stick one to every phone in the house? Then if you ever need to call the police again, it'll be right there.
