I would accept the offer because no one as far as I am aware has been able to challenge £12 charges since they were introduced.
Sorry, but that is completely untrue. A lot of people, myself included, have filed court claims against credit card companies for the whole amount, and got ALL of the money back. The OFT has only made a recommendation but as long as no credit card company tells us how much it REALLY costs them, the £12 can be challenged. I would not accept the offer but write back again saying you want the full money within 14 days, and file a claim if they don't do so. Credit cards are not affected by the OFT test case.Reclaimed thanks to this site:

Is it the same procedure to claim as you would use for reclaiming from a bank? I too am having big problems with Egg. Thanks.Sandie0

I have been through the process of reclaiming a series of £20 overlimit charges from Egg. I have had no joy, so i started a small claim against them. They have employed a firm of solicitors to defend their case. The OFT had a ruling that Egg were allowed to charge £16 for an overlimit charge, will this ruin my claim against them?. I turned down an offer of the £4 difference. I am getting a bit nervous about this now. Any advice would be greatly appreciated.0

Hi Tony,
I think you're doing the right thing by standing firm and taking this all the way. The way I see it, is it'll go one of three ways:
1. The court sides with Egg, and you get nothing. I think this is somewhat unlikely given the OFT ruling(s). But, it's possible, and all you'll have lost is the charges, plus any court costs.
2. The court agrees with Egg's earlier offer, and awards you £4 per charge back... you've still technically won against Egg, so could probably claim costs too.
3. The court awards you more than £4 back per penalty charge - you're a winner!!

I had a delay in carrying on with egg, until they mailed me saying their charges are lawful and its all my fault yada yada yada.
Filing with mcol a week today.
Has anyone else been dealing with egg recently? its been a while since the last post in here and im wondering if they are still using the same tactics through the process.

hiya - wondered if anyone could help
we just got letters back from egg regarding us asking for all charges back etc
standard letter saying we signed agreement etc blah blah blah and if we were still unhappy we had 6 months to take it to the financial umbudsman
what is our next step?
on this forum it would be to threaten to take them to court
do we go ahead and threaten legal action or do we take it to umbudsman as they said?

I was going thru the process with Egg, i got letter back saying all charges lawful etc etc... but i never got the list of charges so i wrote back asking for the list, and the difference between charge and OFT ruling....
A week later they sent me a letter saying i had only 3 charges, and i could have them back with interest. £71!
Result, as of all my accounts this was one of the better managed ones so i knew i didn't have much by way of charges.
Stick with it! Proof that they will refund all charges if prodded! Plus interest, what a bonus!I'm just a seething mass of contradictions....(it's part of my charm!)0
