Samsung Apollo - Broken after 5 weeks. - UPDATE on repair - UPDATED AGAIN
I have a Samsung Galaxy apollo and after 5 weeks the phone would no longer make or receive calls, although internet connection was great.
I returned phone to CPW and nearly 3 weeks later after sending to Samsung, they say it is beyond repair and was a prob caused by dropping. They wont give a replacement or anything.
Only having the phone for 5 weeks I know I never dropped it and its had a soft case on since new.
Can I do anything?

Thanks all, Aparently they say there is moisture inside the handset.
Now I know I have never dropped it in water, is it possible it may be condensation from being at swimming pool and inside my handbag and it being sunny outside?!
They have photos of the moisture but I havent seen them yet, will be checking to see if it is clearly my phone, I guess the EMI number should be shown in the photo.

Picked up phone and now it wont even turn on!! Had perfect internet connection when I took it in and now it is useless. Photo of moisture damage was such a close up of a circuit board that in no way could you tell for cetain what the phone was.
Phones are sent away for repair inside zip lock plastic bags, surely this wouldnt help any moisture damage?
There is nothing thay will do as they say due to the moisture damage the internet connection would have broken anyway.
They wouldnt give it to me in writing that my phone now would not turn on so if I took it c=back again I have no proof I havent broke it further (IYKWIM), not that there is any point in me taking it back.
Bascially they have been no help and according to them it is an electrical device and is not intended to be used in the rain/showers etc, and in their words the same way you dont watch a tv in the rain as it would break it!!
Really cross but looks like nothing I can do about it, 5 week old phone fit for the bin.

You could send it to Samsung direct for a second opinion.
If that comes back same, not much you can do I think than get a new phone.0 -
Thanks, Think I will contact Samsung myself on Monday. Obv I cant prove I didnt drop it so surely thay can just say that to save them having to give me a new one.0

Its not upto you to prove you havent dropped it. Its upto them to prove you have. If they are getting !!!!!! call in trading standards and get them to help you. Phone is only 5 weeks old well within any warenty."Save the cheerleader - Save the world"0

They can't just say, especially "probably". First 6 months they must prove what they say....they say it is beyond repair and was a prob caused by dropping.

Remember though that Samsung are under no obligation to do anything. It is CPW who your contract of sale is with and they need to put it right. As others have said for the first 6 months they would have to prove you broke it as in law for the first 6 months it is assumed it was an inherent fault, (assuming there isn't evidence it has been damaged). Samsung may fix it f.o.c as some manufacturers offer their own warranty but they are not obligated to do so.0

Because whilst they were not forced to offer a warranty in the first place, they chose to offer one anyway. If you offer a warranty you are obliged to abide by the terms that you laid out in that warranty.
A manufacturers warranty typically offers rights in addition to those that are statutory to the consumer and often provide a way to circumvent the retailer to the benefit of the consumer who can generally get repairs/replacements much more quickly from the OEM.0 -
You have misunderstood. I am saying they are not obliged if they don't offer a warranty. Some people seem to think that they can contact the manufacturer of any product to get it fixed under warranty but they can't unless the manufacturer offers such a warranty. They are not obligated to offer a warranty although some do. The point is it is the retailer who is legally bound to have things fixed things under warranty.0
